yet he made no effort to take it down or to support it with timbers or<br />

even to warn <strong>the</strong> o<strong>the</strong>r man <strong>of</strong> <strong>the</strong> danger. Probably he had paid no<br />

attention to it <strong>and</strong> made no effort to find out w^he<strong>the</strong>r it was safe or not.<br />

Stephen Seinor, laborer, was instantly killed on <strong>the</strong> tipple at <strong>the</strong><br />

Beach Cliff mine on December 24. He was struck by a trip <strong>of</strong> three<br />

full cars which ran into <strong>the</strong> tipple with terrible velocity, caused by<br />

<strong>the</strong> breaking- <strong>of</strong> a draw-bar on <strong>the</strong> last car to which <strong>the</strong> incline rope was<br />

attached. There are two safety switches on <strong>the</strong> incline, one about one-<br />

third <strong>of</strong> <strong>the</strong> distance or length <strong>of</strong> <strong>the</strong> incline from <strong>the</strong> top, <strong>and</strong> <strong>the</strong> o<strong>the</strong>r<br />

about <strong>the</strong> same distance from <strong>the</strong> bottom. When <strong>the</strong> draw-bar broke <strong>the</strong><br />

trip was near <strong>the</strong> lower switch <strong>and</strong> before it could be closed had passed<br />

over it. This switch could not be placed any nearer to <strong>the</strong> tipple on<br />

account <strong>of</strong> <strong>the</strong> public road, but I suggested that <strong>the</strong>y provide a stop<br />

block near <strong>the</strong> bottom <strong>of</strong> <strong>the</strong> incline <strong>and</strong> to use safety chains on <strong>the</strong> cars<br />

hereafter, but as this is a matter not provided for in <strong>the</strong> mining-law I<br />

can do nothing but advise.
