West Donnelly mine <strong>and</strong> May field mine are both on <strong>the</strong> west side <strong>of</strong><br />

<strong>the</strong> railroad <strong>and</strong> are connected with each o<strong>the</strong>r by a traveling way underground,<br />

made however since <strong>the</strong> action <strong>of</strong> <strong>the</strong> mine Inspector. There<br />

are employed in West Donnelly about 45 men <strong>and</strong> in Mayfield about 37<br />

men, making a total <strong>of</strong> about 127 in <strong>the</strong> three mmes, or about 103 miners.<br />

Andrew Neish is mine-boss for both West <strong>and</strong> East Donnelly mines,<br />

<strong>and</strong> Peter Glenn mine-boss for <strong>the</strong> Mayfield mine, he acting also as<br />

superintendent <strong>of</strong> <strong>the</strong> three mines inside <strong>and</strong> outside. Each <strong>of</strong> <strong>the</strong>se<br />

three mines has its own tipple, <strong>and</strong> we underst<strong>and</strong> that each <strong>of</strong> <strong>the</strong>se<br />

three mines are separatelj^ ventilated.<br />

We hereby <strong>of</strong>fer or submit <strong>the</strong> above as a report <strong>of</strong> <strong>the</strong> facts.<br />

In re-appeal <strong>of</strong> i<br />

By <strong>the</strong> Court: On 30 June, 1885 <strong>the</strong> legislature <strong>of</strong> this commonwealth<br />

passed an act entitled " An act relating to <strong>bituminous</strong> coal mines <strong>and</strong><br />

providing for <strong>the</strong> lives, health, safety <strong>and</strong> welfare <strong>of</strong> persons employed<br />

<strong>the</strong>rein." It was intended to be a complete system. Everything is re-<br />

quired that was thought to be for <strong>the</strong> welfare <strong>of</strong> <strong>the</strong> miners, <strong>and</strong> every-<br />

thing prohibited that was likely to prove detrimental to <strong>the</strong> lives, health<br />

or safetj^ <strong>of</strong> those employed in such mines.<br />

Among o<strong>the</strong>r provisions <strong>the</strong> act provides for <strong>the</strong> appointment <strong>of</strong> In-<br />

spectors, <strong>and</strong> prescribes minutely <strong>the</strong> duties to be performed by such<br />

<strong>Inspectors</strong>. It is one <strong>of</strong> <strong>the</strong> duties <strong>of</strong> an Inspector " to examine <strong>the</strong> mines<br />

in liis district, as <strong>of</strong>ten as possible, which shall not be less than once in<br />

three months, to see that <strong>the</strong> provisions <strong>of</strong> this act are observed <strong>and</strong><br />

strictly carried out."<br />

In pursuance <strong>of</strong> his duty William Jenkins, an Inspector <strong>of</strong> <strong>the</strong> Second<br />

ilistrict, on <strong>the</strong> 30th <strong>of</strong> April, 1890, gave notice to John P. Brennen,<br />

superintendent <strong>of</strong> <strong>the</strong> McClure Coke Company, that but one mine-boss<br />

was employed for two mines, known as Bessemer <strong>and</strong> Eising Sun, con-<br />

trary to <strong>the</strong> provisions <strong>of</strong> <strong>the</strong> fifth section <strong>of</strong> <strong>the</strong> said act <strong>of</strong> assembly,<br />

<strong>and</strong> requested an additional mine-boss to be employed by said company.<br />

From this decision <strong>of</strong> <strong>the</strong> Inspector an appeal was taken to <strong>the</strong> court <strong>of</strong><br />

quarter sessions under <strong>the</strong> fourteenth section <strong>of</strong> <strong>the</strong> act. Again it was<br />

.ilecided by <strong>the</strong> Inspector that <strong>the</strong> INIcClure Company was violating <strong>the</strong><br />

ififth section in employing only one mining-boss for <strong>the</strong> mines known as<br />

Donnelly No. 1, Donnelly No. 2 <strong>and</strong> Mayfield, <strong>and</strong> also in employing one<br />

mining-boss for Hazlett shaft <strong>and</strong> Hazlett slope. From <strong>the</strong>se latter de-<br />
