A prelim<strong>in</strong>ary <strong>in</strong>terview is conducted by the police <strong>in</strong> view of gather<strong>in</strong>g <strong>in</strong><strong>for</strong>mation on identity,<br />

nationality <strong>and</strong> travel route. If the police consider that the <strong>asylum</strong> seeker’s statement is not<br />

credible, the Chief of the Police may decide to refuse entry <strong>in</strong>to the country. If the police consider<br />

the <strong>asylum</strong> seeker’s statement credible the application <strong>for</strong> <strong>asylum</strong> is <strong>for</strong>warded to the Directorate<br />

<strong>for</strong> Immigration under the M<strong>in</strong>istry of Justice who is responsible <strong>for</strong> tak<strong>in</strong>g the decision on <strong>asylum</strong>.<br />

No <strong>for</strong>mal appeal is possible aga<strong>in</strong>st a decision of rejection at the border <strong>and</strong> the applicant will be<br />

required to leave the country immediately.<br />

Entry <strong>in</strong> to the territory.<br />

Asylum <strong>seekers</strong> who are not rejected at the border upon arrival are allowed to enter the territory<br />

<strong>and</strong> are admitted to the <strong>asylum</strong> determ<strong>in</strong>ation procedure. Applicants who have entered Icel<strong>and</strong><br />

il<strong>legal</strong>ly must submit their application to the Directorate <strong>for</strong> Immigration with<strong>in</strong> the country.<br />

First <strong>in</strong>stance decisions under the <strong>asylum</strong> determ<strong>in</strong>ation procedure are made by the Directorate<br />

of Immigration. The first <strong>in</strong>stance decision is based on the written record of the police <strong>in</strong>terview as<br />

well as a second <strong>in</strong>terview with the Directorate. Each <strong>asylum</strong> case is notified to the Icel<strong>and</strong>ic Red<br />

Cross <strong>and</strong> one of its representative is present at all <strong>in</strong>terviews. His/her role is ma<strong>in</strong>ly a<br />

humanitarian one.<br />

It is the aim of the Directorate of Immigration to reach a decision with<strong>in</strong> three months from<br />

submission of the application, but at present the process<strong>in</strong>g of an application may take up to ten<br />

months.<br />

Accord<strong>in</strong>g to Section 12a(2) of the Foreign Nationals Supervision Act, <strong>asylum</strong> <strong>seekers</strong> shall be<br />

<strong>in</strong><strong>for</strong>med of their rights of appeal upon notification of a negative first <strong>in</strong>stance decision. They must<br />

also be assisted <strong>in</strong> mak<strong>in</strong>g such appeals.<br />

The appeal must be lodged with the M<strong>in</strong>istry of Justice with<strong>in</strong> 15 days follow<strong>in</strong>g notification of the<br />

decision. If the appeal is lodged be<strong>for</strong>e the deportation measure is carried out (which, <strong>in</strong> practice,<br />

is almost always the case s<strong>in</strong>ce deportation orders are not en<strong>for</strong>ced with<strong>in</strong> these 15 days), it has<br />

suspensive effect until the M<strong>in</strong>ister makes his/her f<strong>in</strong>al decision.<br />

The appeal procedure is an adm<strong>in</strong>istrative one <strong>and</strong> the appellant is not required to appear <strong>in</strong><br />

person. The average process<strong>in</strong>g time <strong>for</strong> the appeal procedure lies approximately around three<br />

months.<br />

In pr<strong>in</strong>ciple, the M<strong>in</strong>ister’s decision is f<strong>in</strong>al. However, if he/she considers that his/her application<br />

has not been processed accord<strong>in</strong>g to the law, the <strong>asylum</strong> seeker has the possibility to lodge an<br />

appeal with the first <strong>in</strong>stance civil court <strong>and</strong> <strong>in</strong> case of rejection, to the Supreme Court.<br />

There is no entitlement to <strong>legal</strong> aid dur<strong>in</strong>g the <strong>in</strong>itial <strong>in</strong>terview with the police. If the representative<br />

from the Icel<strong>and</strong>ic Red Cross considers that <strong>legal</strong> representation should be granted to an<br />

applicant, this is made available <strong>for</strong> the <strong>in</strong>terview with the Directorate of Immigration.<br />

Dur<strong>in</strong>g the appeal procedure <strong>asylum</strong> <strong>seekers</strong> are entitled to five hours of free <strong>legal</strong> counsell<strong>in</strong>g.<br />
