When receiv<strong>in</strong>g the residence permit, the <strong>asylum</strong> seeker will not be <strong>in</strong><strong>for</strong>med about the grounds<br />

whereby it has been granted. As a result, he/she will not know whether he/she has been<br />

recognised as a Convention refugee or been granted a subsidiary <strong>for</strong>m <strong>for</strong> protection. Accord<strong>in</strong>g<br />

to the Dutch authorities, the aim of this provision is to prevent persons who have been granted<br />

humanitarian or temporary protection status from embark<strong>in</strong>g on further proceed<strong>in</strong>gs to obta<strong>in</strong><br />

Convention status.<br />

The spouse or m<strong>in</strong>or children of a person granted a residence permit will be entitled to receive<br />

the same status provided that they have arrived <strong>in</strong> the Netherl<strong>and</strong>s with<strong>in</strong> three months after<br />

he/she has been granted this residence permit.<br />

After the <strong>in</strong>itial period of three years, it will be possible to apply <strong>for</strong> a permanent residence permit.<br />

Procedure<br />

The decision on the application must be made with<strong>in</strong> six months, although this can be extended<br />

<strong>for</strong> another six months. However, the M<strong>in</strong>ister of Justice has the authority to postpone the<br />

exam<strong>in</strong>ation of the <strong>asylum</strong> applications of certa<strong>in</strong> groups <strong>for</strong> a period of one year, if:<br />

– it is to expected that, <strong>for</strong> a short period of time, there will be uncerta<strong>in</strong>ties about the situation <strong>in</strong><br />

the country of orig<strong>in</strong>;<br />

– the situation <strong>in</strong> the country of orig<strong>in</strong>, on the basis of which the application is submitted, will be<br />

of short duration;<br />

– the number of applications submitted is so important that the normal time limit <strong>for</strong> process<strong>in</strong>g<br />

the applications cannot be met.<br />

Dur<strong>in</strong>g the suspension period, applicants will be given the same <strong>social</strong> rights as other <strong>asylum</strong><br />

<strong>seekers</strong>. If the situation <strong>in</strong> their country of orig<strong>in</strong> has not improved after the one-year period, the<br />

normal procedure will then start.<br />

Another <strong>in</strong>novation <strong>in</strong> the new Draft Aliens Act is the replacement of the current adm<strong>in</strong>istrative<br />

review procedure (see under “Adm<strong>in</strong>istrative review” above) by a so-called “<strong>in</strong>tention procedure”.<br />

Accord<strong>in</strong>g to this, when <strong>in</strong>tend<strong>in</strong>g to take a negative decision on an application, the adm<strong>in</strong>istrative<br />

authority will communicate the draft decision <strong>and</strong> the reasons <strong>for</strong> it to the <strong>asylum</strong> seeker. The<br />

applicant or his/her <strong>legal</strong> representative can then submit comments on this draft be<strong>for</strong>e the f<strong>in</strong>al<br />

decision is taken.<br />

Unlike the current adm<strong>in</strong>istrative review, the new “<strong>in</strong>tention procedure” will not be regulated by<br />

Dutch adm<strong>in</strong>istrative law, which guarantees fairness <strong>and</strong> efficiency.<br />

Social <strong>and</strong> economic rights<br />

All holders of the residence permit <strong>in</strong> the <strong>in</strong>itial three-year period will have the same <strong>social</strong> <strong>and</strong><br />

economic rights <strong>and</strong> benefits <strong>in</strong> accordance with the level required under the Geneva Convention.<br />

Thus, the exist<strong>in</strong>g differences between Convention <strong>refugees</strong> <strong>and</strong> persons with residence permits<br />

<strong>for</strong> humanitarian reasons or with provisional residence permits will disappear dur<strong>in</strong>g this period.<br />

Negative decisions<br />

The rejection of an <strong>asylum</strong> application (designed as “application <strong>for</strong> the issuance of a residence<br />

permit <strong>for</strong> def<strong>in</strong>ite period”) will automatically encompass the follow<strong>in</strong>g <strong>legal</strong> consequences:<br />

– the rejected <strong>asylum</strong> seeker no longer has lawful residence <strong>in</strong> the Netherl<strong>and</strong>s <strong>and</strong> must leave<br />

the country;<br />
