Germany <strong>and</strong> are caught by the police near the border are dealt with under the Dubl<strong>in</strong> procedure<br />

<strong>in</strong> Denmark, but with shorter time limits <strong>for</strong> send<strong>in</strong>g <strong>and</strong> answer<strong>in</strong>g the requests to take charge.<br />

All decisions made under the Dubl<strong>in</strong> procedure are communicated <strong>in</strong> writ<strong>in</strong>g to the applicants,<br />

who must be <strong>in</strong><strong>for</strong>med of their right to contact the Danish Refugee Council <strong>for</strong> <strong>in</strong><strong>for</strong>mation <strong>and</strong><br />

counsell<strong>in</strong>g. The decisions of the Immigration Service can be appealed to the M<strong>in</strong>ister of Interior,<br />

but appeals have no suspensive effect.<br />

Applicants processed under the Dubl<strong>in</strong> procedure are issued with a registration card, which is<br />

valid <strong>for</strong> one year <strong>and</strong> renewable on a one-year basis. They are granted the same type of<br />

accommodation <strong>and</strong> <strong>social</strong> rights as other <strong>asylum</strong> <strong>seekers</strong> pend<strong>in</strong>g the decision of the requested<br />

state.<br />

Entry <strong>in</strong>to the territory<br />

An <strong>asylum</strong> seeker who arrives <strong>in</strong> Denmark <strong>and</strong> is not rejected at the border will be allowed entry <strong>in</strong>to<br />

the territory <strong>and</strong> admission to the determ<strong>in</strong>ation procedure. Those who have entered il<strong>legal</strong>ly may<br />

lodge their application directly with the Immigration Service. Applicants who contact other <strong>in</strong>stitutions<br />

are referred to the Immigration Service.<br />

Immediately after entry, the <strong>asylum</strong> seeker will be taken to a registration centre at S<strong>and</strong>holm or<br />

Avsntrup, respectively north <strong>and</strong> east of Copenhagen. Both centres are run by the Danish Red Cross<br />

on behalf of the Immigration Service. Upon registration, the <strong>asylum</strong> seeker will be required to give<br />

his/her name, address, date of birth <strong>and</strong> a brief statement expla<strong>in</strong><strong>in</strong>g his/her motives <strong>for</strong> seek<strong>in</strong>g<br />

<strong>asylum</strong>. If the person can establish his/her identity <strong>and</strong> travel route, he/she will be transferred to the<br />

Red Cross reception camp. If there is <strong>in</strong>sufficient <strong>in</strong><strong>for</strong>mation to establish identity <strong>and</strong> travel route, the<br />

<strong>asylum</strong> seeker can be deta<strong>in</strong>ed <strong>in</strong> the prison section of S<strong>and</strong>holm camp (under the responsibility of<br />

the M<strong>in</strong>istry of Justice) until the <strong>in</strong><strong>for</strong>mation can be satisfactorily established. Asylum <strong>seekers</strong> may<br />

also be deta<strong>in</strong>ed subsequently if they fail to attend an <strong>in</strong>terview with the police.<br />

After a short period <strong>in</strong> the reception camp, the <strong>asylum</strong> seeker will be asked to complete a<br />

questionnaire detail<strong>in</strong>g family <strong>and</strong> work circumstances, military service, f<strong>in</strong>ancial circumstances,<br />

political activities <strong>and</strong> reasons <strong>for</strong> seek<strong>in</strong>g <strong>asylum</strong>. The completed questionnaire is then translated.<br />

However, <strong>asylum</strong> <strong>seekers</strong> from European countries, <strong>in</strong>clud<strong>in</strong>g most eastern European countries <strong>and</strong><br />

certa<strong>in</strong> African countries, do not complete the questionnaire because it is generally presumed that, <strong>in</strong><br />

most cases, they will not be granted <strong>asylum</strong> <strong>in</strong> Denmark. These applications are processed under a<br />

fast-track procedure <strong>in</strong>troduced with<strong>in</strong> the manifestly unfounded procedure (see below).<br />

Hereafter all <strong>asylum</strong> <strong>seekers</strong> attend an <strong>in</strong>terview with a representative of the Immigration Service,<br />

where they will be given the opportunity to expla<strong>in</strong> <strong>in</strong> greater detail the replies given <strong>in</strong> the<br />

questionnaire. Interpreters are provided, when necessary.<br />

On the basis of the <strong>in</strong><strong>for</strong>mation given dur<strong>in</strong>g the <strong>in</strong>terview, <strong>asylum</strong> <strong>seekers</strong> will be placed either <strong>in</strong> the<br />

manifestly unfounded procedure or <strong>in</strong> the normal determ<strong>in</strong>ation procedure.<br />

Manifestly unfounded procedure<br />

Normal manifestly unfounded procedure: if the Immigration Service decides to place an application<br />

<strong>in</strong> the manifestly unfounded procedure, the case will be <strong>for</strong>warded to the Danish Refugee Council<br />

(DRC) <strong>for</strong> <strong>in</strong>dependent review.<br />

A representative of the DRC’s Asylum Department will <strong>in</strong>terview the <strong>asylum</strong> seeker to ensure that all<br />

relevant <strong>in</strong><strong>for</strong>mation has emerged from the questionnaire <strong>and</strong> the <strong>in</strong>terview with the Immigration<br />

Service. An <strong>in</strong>terpreter is provided if necessary. As far as possible, female applicants are <strong>in</strong>terviewed<br />

by a woman.<br />
