Detention<br />

Aliens benefit<strong>in</strong>g from this stay of deportation are entitled to the same rights as <strong>asylum</strong> <strong>seekers</strong>.<br />

Accord<strong>in</strong>g to the Secretary of State, a stay of deportation should be granted <strong>for</strong> a short period of<br />

time <strong>and</strong> should be replaced by a provisional residence permit if the situation <strong>in</strong> the country of<br />

orig<strong>in</strong> does not improve rapidly. In practice, however, aliens often rema<strong>in</strong> with a stay of<br />

deportation <strong>for</strong> over a year.<br />

Stays of deportation are meant <strong>for</strong> specific groups or nationalities. Rejected <strong>asylum</strong> <strong>seekers</strong> who<br />

cannot be removed but who do not belong to a group or nationality under a stay of deportation,<br />

have no possibility of be<strong>in</strong>g granted a residence permit. Only those who are ill <strong>and</strong> cannot travel<br />

because of their health problems may be granted a stay of deportation, valid <strong>for</strong> the time of their<br />

illness.<br />

A more restrictive policy will be <strong>in</strong>troduced <strong>in</strong> the course of 2000. So far, a rejected <strong>asylum</strong> seeker<br />

was granted cont<strong>in</strong>ued accommodation <strong>and</strong> f<strong>in</strong>ancial assistance, if he/she could prove that<br />

he/she had made sufficient ef<strong>for</strong>ts to obta<strong>in</strong> travel documents from the authorities of his/her<br />

country of orig<strong>in</strong> <strong>in</strong> order to return.<br />

Under the new provisions, a rejected applicant will no longer be granted accommodation <strong>and</strong><br />

f<strong>in</strong>ancial assistance after the f<strong>in</strong>al decision of rejection. In addition, the full burden of prov<strong>in</strong>g that<br />

he/she is not able to return to his/her country of orig<strong>in</strong> will always lie with the alien, except <strong>in</strong><br />

some exceptional circumstances.<br />

Asylum <strong>seekers</strong> who arrive by air are processed <strong>in</strong> the Application Centre (AC) of the Amsterdam<br />

Schiphol airport. When the application is considered to be <strong>in</strong>admissible or manifestly ungrounded,<br />

<strong>asylum</strong> <strong>seekers</strong> are always deta<strong>in</strong>ed at the “Grenshospitium” to facilitate their removal from the<br />

country. The “Grenshospitium” is a special prison, located near the Application Centre of<br />

Schiphol, designed <strong>for</strong> aliens who are not allowed to enter the country.<br />

One of the five District Courts reviews, on appeal, if the detention is lawful. The court reconsiders<br />

the decision of the IND to process the application under the accelerated procedure <strong>and</strong>,<br />

depend<strong>in</strong>g on this, whether or not detention should be ordered. If not, the IND must release the<br />

applicant <strong>and</strong> send him/her to a Screen<strong>in</strong>g <strong>and</strong> Reception Centre (OC).<br />

In pr<strong>in</strong>ciple, <strong>asylum</strong> <strong>seekers</strong> apply<strong>in</strong>g <strong>in</strong> the other Application Centres can also be deta<strong>in</strong>ed, but<br />

this rarely happens. Asylum <strong>seekers</strong> rejected under accelerated procedure <strong>in</strong> the ACs of<br />

Zevenaar <strong>and</strong> Rijsbergen are usually asked to move out of the centre <strong>and</strong> required to leave the<br />

country by themselves.<br />

In the deportation phase, detention is only possible if there is a risk that the <strong>asylum</strong> seeker may<br />

avoid deportation by go<strong>in</strong>g <strong>in</strong>to hid<strong>in</strong>g. However, a more restrictive policy regard<strong>in</strong>g the treatment<br />

of rejected applicants will be <strong>in</strong>troduced <strong>in</strong> the course of 2000. Accord<strong>in</strong>g to this, detention under<br />

deportation proceed<strong>in</strong>gs will be used more often <strong>and</strong> a rejected <strong>asylum</strong> seeker will be declared<br />

"persona non grata” if the aliens police note his/her cont<strong>in</strong>u<strong>in</strong>g il<strong>legal</strong> presence <strong>in</strong> the<br />

Netherl<strong>and</strong>s, on two occasions. The authorities also <strong>in</strong>tend to en<strong>for</strong>ce the exist<strong>in</strong>g rules more<br />

strictly.<br />

Applications from abroad<br />

An <strong>asylum</strong> seeker who is <strong>in</strong> a third country <strong>and</strong> wishes to apply <strong>for</strong> <strong>asylum</strong> <strong>in</strong> the Netherl<strong>and</strong>s<br />

must submit his/her application to the UNHCR representation <strong>in</strong> that country. If there is no<br />

UNHCR representation, the <strong>asylum</strong> request can be made at the Dutch embassy. There are no<br />

clear regulations on the process<strong>in</strong>g of such requests.<br />
