6. the <strong>asylum</strong> seeker does not have travel documents, unless he/she immediately registers as<br />

an <strong>asylum</strong> seeker upon arrival <strong>in</strong> the Netherl<strong>and</strong>s.<br />

Under Section 15c of the amended Aliens Act, an <strong>asylum</strong> application may be rejected as<br />

manifestly unfounded if:<br />

1. it is not founded on any of the grounds which reasonably give rise to a <strong>legal</strong> ground <strong>for</strong><br />

admission <strong>in</strong> the Netherl<strong>and</strong>s;<br />

2. the <strong>asylum</strong> seeker has the nationality of a third country, <strong>and</strong> it appears that he/she will receive<br />

adequate protection <strong>in</strong> that country;<br />

3. a third country will readmit the <strong>asylum</strong> seeker until he/she has found last<strong>in</strong>g protection<br />

elsewhere;<br />

4. the <strong>asylum</strong> seeker produces travel or identity documents that do not apply to him;<br />

5. the applicant comes from a designated safe country of orig<strong>in</strong> (EU countries, Switzerl<strong>and</strong>,<br />

Liechtenste<strong>in</strong>, Icel<strong>and</strong>, Norway, Ghana, Senegal, Bulgaria, Hungary, Czech, Pol<strong>and</strong>,<br />

Rumania <strong>and</strong> Slovakia);<br />

6. the <strong>asylum</strong> seeker does not provide any documents concern<strong>in</strong>g his/her identity, it<strong>in</strong>erary or<br />

<strong>asylum</strong> motives.<br />

The “safe third country” rule is only used <strong>in</strong> cases where the applicant has already obta<strong>in</strong>ed<br />

refugee status <strong>in</strong> another country or when it is certa<strong>in</strong> that he/she will be allowed access to the<br />

<strong>asylum</strong> procedure <strong>in</strong> the country concerned. In practice, the rule rarely applies because it is<br />

overruled by the Dubl<strong>in</strong> Convention <strong>and</strong> all the states neighbour<strong>in</strong>g the Netherl<strong>and</strong>s are Dubl<strong>in</strong><br />

countries.<br />

Asylum <strong>seekers</strong> rejected on <strong>in</strong>admissibility or manifestly unfounded grounds may appeal directly<br />

to one of the five District Courts, if the rejection is comb<strong>in</strong>ed with detention (as it is the case at<br />

Schiphol airport). The appeal has to be lodged with<strong>in</strong> 24 hours <strong>and</strong> suspensive effect must be<br />

requested separately. If the rejection is not comb<strong>in</strong>ed with detention, the <strong>asylum</strong> seeker must first<br />

appeal <strong>for</strong> review at the IND <strong>and</strong> then, <strong>in</strong> case of a confirmation, to the Court. Adm<strong>in</strong>istrative<br />

review <strong>and</strong> judicial appeals are described under “Adm<strong>in</strong>istrative review” <strong>and</strong> “Appeal” below.<br />

Second stage: exam<strong>in</strong>ation on the merits<br />

When the application is deemed admissible <strong>and</strong> not manifestly unfounded, it is then exam<strong>in</strong>ed on<br />

the merits. Officially the decision is taken by the Secretary of State but <strong>in</strong> practice, IND will make<br />

the decision on behalf of the Secretary of State.<br />

The basic rule is that a decision <strong>in</strong> the first <strong>in</strong>stance should be made with<strong>in</strong> six months, but this is<br />

rarely the case. Sometimes the first <strong>in</strong>stance procedure will take more than a year, depend<strong>in</strong>g on<br />

nationality <strong>and</strong> numbers of <strong>asylum</strong> <strong>seekers</strong> enter<strong>in</strong>g the territory <strong>and</strong> on the process<strong>in</strong>g capacity<br />

of the IND. If no decision has been made with<strong>in</strong> the six months, an application <strong>for</strong> review can be<br />

made (see under “Adm<strong>in</strong>istrative review” below).<br />

Adm<strong>in</strong>istrative review<br />

Asylum <strong>seekers</strong> whose claims have been rejected may apply to the Secretary of State <strong>for</strong> a<br />

review of their case. If the <strong>asylum</strong> application is deemed admissible, the application <strong>for</strong> review will<br />

be submitted to the Advice Committee <strong>for</strong> Aliens Affairs.<br />
