SOCIAL CONDITIONS FOR PERSONS UNDER TEMPORARY PROTECTION<br />

Introduction<br />

Persons under temporary protection do not need to go through the <strong>in</strong>dividual eligibility procedure.<br />

However, if they wish to do so, they may apply <strong>for</strong> <strong>asylum</strong> with the Federal Asylum Office.<br />

Unlike Convention <strong>refugees</strong>, persons under temporary protection are not entitled to <strong>in</strong>tegration<br />

assistance (e.g. language <strong>and</strong> vocational tra<strong>in</strong><strong>in</strong>g, accommodation allowances <strong>and</strong> other f<strong>in</strong>ancial<br />

support) <strong>and</strong> are not allowed to work without a work permit. However, they benefit from an<br />

assistance scheme set up <strong>and</strong> jo<strong>in</strong>tly f<strong>in</strong>anced by the federal <strong>and</strong> prov<strong>in</strong>cial governments. As a<br />

result of this, persons under temporary protection – i.e. ma<strong>in</strong>ly Kosovo Albanians – generally<br />

enjoy a more favourable <strong>social</strong> situation than most <strong>asylum</strong> <strong>seekers</strong>.<br />

F<strong>in</strong>ancial assistance/hous<strong>in</strong>g<br />

Work<br />

Persons under temporary protection are offered accommodation <strong>in</strong> a centre (<strong>for</strong>mer hospital), <strong>in</strong><br />

hostels or pensions. Food is provided <strong>and</strong> they have access to medical treatment. No pocket<br />

money is granted.<br />

Those who are accommodated by private <strong>in</strong>dividuals receive a monthly cash grant of ATS 1,500<br />

[EUR 109] per person <strong>and</strong> a monthly pocket money of ATS 200 [EUR 15].<br />

Pursuant to an ord<strong>in</strong>ance of the M<strong>in</strong>ister <strong>for</strong> Labour <strong>and</strong> Social Affairs of 14 July 1997, persons<br />

under temporary protection are allowed to work but they require a work permit <strong>and</strong> are listed as a<br />

“third priority category”.<br />

Language tuition<br />

German language tuition is provided through private organisations.<br />

School attendance<br />

The same rules as <strong>for</strong> <strong>asylum</strong> <strong>seekers</strong> <strong>and</strong> Convention <strong>refugees</strong> apply to the children of persons<br />

under temporary protection.<br />

Mother tongue tuition<br />

If required <strong>and</strong> feasible, children of Kosovo Albanians registered under the temporary protection<br />

scheme obta<strong>in</strong> bil<strong>in</strong>gual tuition as well as vocational tra<strong>in</strong><strong>in</strong>g.<br />

Access to the national health service<br />

All persons under temporary protection are <strong>in</strong>sured under the common health <strong>in</strong>surance plan.<br />

Repatriation<br />

Kosovo Albanians under temporary protection may receive f<strong>in</strong>ancial assistance of ATS 3,000<br />

[EUR 218] to ATS 9,000 [EUR 654] per person depend<strong>in</strong>g on the state of their flat/house <strong>in</strong><br />

Kosovo.<br />
