Asylum Appeal Commission, but has very limited prospect of success.<br />

Entry to the territory<br />

In pr<strong>in</strong>ciple, <strong>asylum</strong> applications must be submitted either at a border cross<strong>in</strong>g po<strong>in</strong>t or at one of<br />

the Swiss airports. If entry <strong>in</strong>to Switzerl<strong>and</strong> is permitted, the applicant is referred to one of four<br />

Federal Registration Centres <strong>in</strong> Chiasso, Basel, Geneva or Kreuzl<strong>in</strong>gen <strong>for</strong> further process<strong>in</strong>g of<br />

his/her <strong>asylum</strong> claim. Aliens who are already <strong>in</strong> the country may apply directly to one of the<br />

Federal Registration Centres.<br />

In practice, only a few <strong>asylum</strong> <strong>seekers</strong> submit their applications <strong>for</strong> <strong>asylum</strong> at the borders. Most<br />

enter Switzerl<strong>and</strong> <strong>legal</strong>ly with a valid visa or il<strong>legal</strong>ly by avoid<strong>in</strong>g border control, <strong>and</strong> file their<br />

<strong>asylum</strong> claim directly with the Federal Registration Centres.<br />

Asylum <strong>seekers</strong> caught by the police when cross<strong>in</strong>g the Swiss border il<strong>legal</strong>ly are normally<br />

h<strong>and</strong>ed over to the appropriate authorities of the neighbour<strong>in</strong>g country. They are <strong>in</strong><strong>for</strong>med<br />

be<strong>for</strong>eh<strong>and</strong> of the location of the nearest Swiss embassy or consulate where they may submit a<br />

<strong>for</strong>mal request <strong>for</strong> <strong>asylum</strong>. If it is not possible to h<strong>and</strong> over the <strong>asylum</strong> seeker, he/she will be<br />

allowed to submit his/her application <strong>in</strong> Switzerl<strong>and</strong> <strong>and</strong> will be referred to one of the Federal<br />

Registration Centres.<br />

Upon registration <strong>in</strong> the Federal Registration Centre, <strong>asylum</strong> <strong>seekers</strong> are f<strong>in</strong>gerpr<strong>in</strong>ted,<br />

photographed <strong>and</strong> required to give personal data <strong>and</strong> <strong>in</strong><strong>for</strong>mation on their family. On this basis<br />

the FOR <strong>in</strong>vestigates whether or not an applicant has requested <strong>asylum</strong> <strong>in</strong> Switzerl<strong>and</strong> previously<br />

<strong>and</strong> under which identity. Asylum <strong>seekers</strong> undergo a prelim<strong>in</strong>ary <strong>in</strong>terview concern<strong>in</strong>g their travel<br />

route <strong>and</strong> the reasons <strong>for</strong> leav<strong>in</strong>g their country of orig<strong>in</strong>.<br />

Admissibility procedure / manifestly unfounded applications<br />

Admissibility<br />

In accordance with Sections 32 <strong>and</strong> 33 of the Asylum Law, Swiss <strong>asylum</strong> authorities have the<br />

right to refuse to exam<strong>in</strong>e the merits of an <strong>asylum</strong> application <strong>for</strong> <strong>for</strong>mal reasons. This decision of<br />

“not to enter <strong>in</strong>to the matter” (“Nichte<strong>in</strong>tretensentscheid”, “non-entrée en matière”) may be taken<br />

<strong>in</strong> the follow<strong>in</strong>g situations:<br />

– the applicant has no travel document or other document establish<strong>in</strong>g his/her identity. However,<br />

this does not apply if he/she gives conv<strong>in</strong>c<strong>in</strong>g arguments expla<strong>in</strong><strong>in</strong>g why he/she cannot<br />

provide such documentation, or if there are <strong>in</strong>dications of persecution;<br />

– he/she has given a false identity;<br />

– he/she has <strong>in</strong>fr<strong>in</strong>ged <strong>in</strong> another way his/her obligation to co-operate with the authorities;<br />

– he/she has the option to travel to another country, where an application <strong>for</strong> <strong>asylum</strong> is still<br />

pend<strong>in</strong>g, or which is responsible <strong>for</strong> process<strong>in</strong>g his/her application <strong>in</strong> accordance with an<br />

<strong>in</strong>ternational convention, provided that this country will not send him/her to another country<br />

where he/she would be exposed to <strong>in</strong>human treatment;<br />

– he/she has already had an <strong>asylum</strong> claim processed <strong>and</strong> rejected <strong>in</strong> Switzerl<strong>and</strong>, or he/she has<br />

withdrawn his/her request <strong>for</strong> <strong>asylum</strong>, or he/she has returned to his/her country of orig<strong>in</strong> dur<strong>in</strong>g<br />

the <strong>asylum</strong> procedure, unless new elements which may justify the grant<strong>in</strong>g of refugee status or<br />

provisional admission have occurred <strong>in</strong> the meantime;<br />
