of some of the specific provisions. For example,
amendments and changes proposed to Article
24 of the Basic Law, have progressive nature and
aim to upgrade constitutional provision for human
rights. According to these changes, Part I
has been added to Article 24 in the following contents:
“I. Human dignity is protected and is being
respected”. In many constitutions, for example,
in the constitution of Germany, human dignity
is given as the main source of human rights. By
adding such a provision to the constitution of the
Republic of Azerbaijan, the state takes responsibility
for the protection of human dignity. Thus,
protection of human dignity is added to the list of
fundamental rights.
According to the change made to the III part of
the Basic Law, “It is not allowed to abuse the law”.
There is a wide-spread saying in the West, that
a man’s rights finish at the place where another
man’s rights start. In other words, the people
must realize their rights and freedom within the
law and do not allow for abuse in a legal state.
According to the additions offered to the Article
29 of the Constitution (Property Rights) by
the project of the Referendum Act, “V. Private
property causes social obligations; VI. The property
right over the land may be restricted for
the purpose of social justice and efficient use of
the lands”. Undoubtedly, every citizen owning a
private property must not forget about his social
obligations within society by benefiting from the
large opportunities and liberal business environments
created by the government in the condition
of market economy.
According to the additions and changes offered
to the Article 60 of the Constitution, (“Administrative
and judicial provision of the rights
and freedoms”) “I. The protection of everybody’s
rights and freedom in the administrative way
and on trial, is guaranteed. II. Everybody has a
right for his case to be taken impartially and the
same case to be reviewed in the administrative
proceeding and legal process in a reasonable period
of time. III. Everybody has the right for being
heard in the administrative proceeding and
legal process. IV. Everybody may file a complaint
on the actions and inactivity of state authorities,
political parties, legal persons, municipalities
and officials in the administrative rule and to the
Court”. As it is seen, the changes made to I and
IV parts of the same Article as well as II and III
additions consider improving of the mechanisms
of protecting of the citizens’ rights in the administrative
and judicial way as well as granting of
