Situational analysis of illicit drug issues and responses <strong>in</strong> <strong>the</strong> <strong>Asia</strong>–<strong>Pacific</strong> region<br />

The first case of HIV was identified <strong>in</strong> 1990;<br />
as of mid-2003 <strong>the</strong> cumulative number of<br />
HIV <strong>in</strong>fections was 69,495 . The HIV epidemic<br />
is currently concentrated among IDUs, with<br />
60 per cent of all notified HIV cases . The<br />
movement of HIV from high-risk groups such<br />
as IDUs and sex workers to o<strong>the</strong>r groups <strong>in</strong><br />
society is now well underway, with 40–120<br />
people <strong>in</strong>fected every day . An estimated<br />
220,000 were believed to be liv<strong>in</strong>g with<br />
HIV/AIDS at <strong>the</strong> end of 2003 (Hong, Anh &<br />
Ogden, 2004; Tuyen, 2004; UNAIDS/World<br />
Health Organization, 2004; United Nations<br />
Country Team, 2003) .<br />

HIV prevalence among IDUs has <strong>in</strong>creased<br />
substantially nationwide from 10 .1 per cent<br />
<strong>in</strong> 1996 to 32 per cent <strong>in</strong> 2002 . There are,<br />
however, sites <strong>in</strong> Vietnam where sent<strong>in</strong>el<br />
surveillance has reported HIV prevalence<br />
among IDUs of 40–80 per cent (Bezziccheri<br />
& Bazant, 2004; Cohen, 2003; Ghys et al .,<br />
2003; Tran, 2004; Tran & Pham, 2004) . Co<strong>in</strong>fection<br />
with HIV and hepatitis C (HCV) is<br />
endemic among IDUs: a survey <strong>in</strong> nor<strong>the</strong>rn<br />
Vietnam found that, of those who had HIV,<br />
98 per cent were co-<strong>in</strong>fected with HCV (Vu<br />
et al ., 2004; Walsh et al ., 2004) . As well as<br />
HIV/AIDS and hepatitis C, o<strong>the</strong>r and more<br />
unusual diseases associated with shar<strong>in</strong>g<br />
<strong>in</strong>ject<strong>in</strong>g equipment have been identified,<br />
such as malaria (Chau et al ., 2002) .<br />

Agreements and treaties<br />
Vietnam is a party to <strong>the</strong> United Nations<br />
S<strong>in</strong>gle Convention on Narcotics 1961, <strong>the</strong><br />
Convention on Psychotropic Substances<br />
1971, and <strong>the</strong> Convention aga<strong>in</strong>st <strong>Illicit</strong><br />
Traffick<strong>in</strong>g of Narcotics and Psychotropic<br />
Substances 1988 . In 2002, Vietnam signed<br />
<strong>the</strong> UN Convention Aga<strong>in</strong>st Transnationals<br />
Organised Crime (United States Department<br />
of State, Bureau for International Narcotics<br />
and Law Enforcement Affairs, 2004a) .<br />
Vietnam has signed counter-drug agreements<br />
with Myanmar (1995), Cambodia (1998),<br />
Laos (1998), Ch<strong>in</strong>a (2001), Russia (1998),<br />
Hungary (1998) and Thailand (1998) (<strong>Drug</strong><br />
Enforcement Adm<strong>in</strong>istration, Intelligence<br />
Division, 2003; United States Department of<br />
State, Bureau for International Narcotics and<br />
Law Enforcement Affairs, 2004b) . Vietnam<br />
is a signatory to <strong>the</strong> Association of Sou<strong>the</strong>ast<br />
<strong>Asia</strong>n Nations (ASEAN) declaration for<br />
a drug-free ASEAN by <strong>the</strong> year 2015 .<br />
Policy responses<br />
Address<strong>in</strong>g drug control and prevention is<br />
a high priority for <strong>the</strong> Vietnamese Government<br />
which ma<strong>in</strong>ta<strong>in</strong>s a firm commitment<br />
to supply and demand reduction . Action<br />
plans for anti-drug programs have been<br />
implemented s<strong>in</strong>ce <strong>the</strong> late 1990s and for<br />
2002–2005 <strong>the</strong> aim is to reduce <strong>the</strong> number<br />
of drug <strong>use</strong>rs by 10–20% annually . Despite<br />
<strong>the</strong> government’s determ<strong>in</strong>ation to oppose<br />
drug <strong>use</strong>, <strong>the</strong> national legislation on drug<br />
control and prevention has generally been<br />
fragmented . As of 2001, <strong>the</strong> Law on Narcotic<br />
<strong>Drug</strong>s Prevention and Suppression came <strong>in</strong>to<br />
force . The new law acknowledges that drug<br />
<strong>use</strong> is a social problem and that drug <strong>use</strong>rs<br />
should be viewed as need<strong>in</strong>g assistance<br />
ra<strong>the</strong>r than as offenders or crim<strong>in</strong>als . If a<br />
person is found us<strong>in</strong>g drugs for <strong>the</strong> first time,<br />
<strong>the</strong>y are detoxified and rehabilitated <strong>in</strong> <strong>the</strong><br />
community, but if this does not succeed, <strong>the</strong>y<br />
are <strong>the</strong>n sent to a compulsory rehabilitation<br />
centre . Policy makers essentially believe<br />
<strong>the</strong> rehabilitation of drug <strong>use</strong>rs is <strong>the</strong> only<br />
solution that may expla<strong>in</strong> why <strong>the</strong> duration<br />
spent <strong>in</strong> a compulsory rehabilitation centre<br />
has <strong>in</strong>creased from six months <strong>in</strong> <strong>the</strong> past to<br />
two years today .<br />
