FutureLogic's Statement of Genuine
Issues Of Material Facts In Opposition
To Nanoptix's Motion For Summary
Judgment
48. During 1997 to 2000, FutureLogic
developed a prototype coupon printer
named "PMC-2010-A."
49. The "PMC-2010-A" was intended
for Tokheim Manufacturing Company
("Yokheim"), a manufacturer of fuel
dispensing equipment.
50. The PMC-2010-A printer was
designed to print receipts and coupons
using data received from a gas pump
controller and a network promotional
controller.
51. FutureLogic built the prototype
PMC-2010-A printer in 1997-1998 with
the intention to present it to Tokheim, for
whom FutureLogic developed other gas
pump printers.
52. FutureLogic never presented the
prototype to Tokheim.
53. The finnware for PMC-2010-A
was completed and saved in
FutureLogic's source code vault, Visual
SourceSafe, on January 21, 1998.
54. Visual SourceSafe is a source code
control system that FutureLogic uses to
control and track revisions to source
code.
55. January 21, 1998 is the date
identified as the date of reduction to
practice of the invention of the ' 855
Patent, in FutureLogic's Supplemental
Response to Nanoptix's [nterrogatory
No. 3, served on July 5,2011.
