124. The June 1,2009 declaration of
Mark Meyerhofer states that a decision
was made not to commercialize the
prototype printers and the printers were
therefore not sold or offered for sale.
125. After the June 1,2009 declaration,
USPTO detennined that the claimed
subject matter of the '855 patent was
patentable.
126. Simmy Ahluwalia testified that the
"information exchanged among
FutureLogic, Inc. and The Coca-Cola
Company during the printer development
project was treated as confidential by all
parties involved in this field test."
127. Mark Meyerhofer testified that he
believed both Interleave Systems and
Coca-Cola were under the obligation to
keep, and did keep FutureLogic's
information confidential throughout the
course of the development project and
thereafter.
