B. REASONS FOR RECOMMENDATION FOR APPROVAL:<br />

1. The proposed Suburban land use category and C-1 zoning district reflects the existing<br />

development of the property. It is also consistent with the intent of the former Huntington<br />

Woods DRI development order to provide a small commercial node at a major intersection to<br />

provide nearby residents with the opportunity to purchase convenience goods without leaving the<br />

area.<br />

2. The proposed FLUM and zoning change would correct the existing non-conforming status of<br />

the convenience store on the site, and therefore, allow the transfer of ownership of the property<br />

without adversely impacting the ability of the convenience store to sell beer or be encumbered by<br />

other restrictions associated with the legal non-conforming status of the property.<br />

3. The proposed amendment is not anticipated to have adverse effects on public facilities.<br />

C. APPLICANT’S REASON FOR THE AMENDMENT:<br />

The City is requesting this land use change to allow continued use of the property as a<br />

neighborhood convenience store. The FLUM change to Suburban and zoning change to C-1 will<br />

also make this existing use conforming, which will eliminate encumbrances to the sale of the<br />

property.<br />

D. STAFF ANALYSIS<br />

Existing FLUM & Zoning<br />

The 1-acre property has a current Future Land Use Map (FLUM) designation of<br />

Residential Preservation and a zoning designation of Residential Preservation-2 (RP-2).<br />

The area is within the City and the Urban Service Area. The subject property is not in<br />

the Multi-Modal Transportation District<br />

Residential Preservation and RP-2 Zoning<br />

The existing Residential Preservation FLUM designation category is characterized by<br />

existing homogeneous residential areas within the community predominantly accessible<br />

by local streets. The primary function of this category is to protect existing stable and<br />

viable residential areas from incompatible land use intensities and density intrusions.<br />

Future development primarily will consist of infill due to the built out nature of the areas.<br />

Commercial, office, and industrial land uses are prohibited. Future arterial and/or<br />

expressways should be planned to minimize impacts within this category. Single family,<br />

townhouse and cluster housing may be permitted within a range of up to six units per<br />

acre. Consistency with surrounding residential type and density shall be a major<br />

determinant in granting development approval intended for community services,<br />

infrastructure, and state and federal government facilities.<br />

The subject property is currently zoned Residential Preservation 2 (RP-2). The RP-2<br />

Zoning District is intended to apply to residential development in areas designated<br />

"Residential Preservation" on the Future Land Use Map, preserving the low density<br />
