The amendment application forms include an optional sustainable development<br />

survey that allowed the applicant to provide information about the proximity of<br />

services to the site under review. The form was not completed by the applicant.<br />

F. VESTED / EXEMPT STATUS:<br />

The subject properties are not vested or exempt.<br />

G. CONCLUSION:<br />

Based on the above data and analysis, staff concludes the following:<br />

1. The requested change to the Central Urban land use category would be consistent<br />

with the predominant development pattern occurring along this segment of West<br />

Brevard Street. The proposed CU land use category allows office, commercial and<br />

retail activities, along with a variety of housing types, all of which are located in the<br />

vicinity of the subject site.<br />

2. The proposed amendment site does not generally meet the criteria for Residential<br />

Preservation as established by Land Use Policy 2.2.3.<br />

3. The proposed amendment eliminates a legal nonconforming land use created at the<br />

adoption of the Comprehensive Plan which further and supports the intent of Land<br />

Use Objective 1.5.<br />

4. Approval of the amendment would support and further recommendations from the<br />

Frenchtown Revitalization Plan which direct commercial areas along West Brevard<br />

Street to provide walkability to goods and services for the Frenchtown/Springfield<br />

community.<br />

5. The subject site is located in the Mobility District. Approval of this amendment<br />

would further the goal of the Mobility District, by allowing mixed use development,<br />

and higher intensities and densities, a prerequisite for successful implementation of<br />

mass transit and other alternative modes of transportation.<br />

6. Approval of this amendment is not expected to have adverse effects on public<br />

facilities.<br />

Thus, based on the data, analysis, and conclusions, staff is recommending approval of<br />

this amendment.<br />
