Defect Liability & Maintenance Clause
1) The Contractor will have to give guarantee on stamp paper of Rs. 100/- for the
work executed under the agreement for a period of 2 years from the date of
completion of work. During this period of 2 Years the contractor will have to
execute all repairs and damages caused due to any reason for one work executed
by him under the agreement without charging any extra cost.
2) The Contractor will have to maintain the work executed by him in good
condition during the guarantee period.
3) The Contractor will have to carryout repairing work within 8 days from the date
concerned authority informs the damages/repairs to the contractor.
4) During the guarantee period, if the company/contractor’s firm gets dissolved or
some new partners are introduced then the responsibility of the guarantee period
will have to be borne by the new company/contractor’s firm.
5) For enforcing the guarantee the security deposit 8% paid by the agency shall be
released as under.
i) Initial Security Deposit 3% paid in the form of D.D. shall be released along with
final bill.
ii) The remaining 5% security deposit recovered in cash through R.A. bills shall be
released after the expiry of defect liability period of 2 years and only after the
joint inspection of Executive Engineer and the representative of the contractor
and if the work is found to be satisfactory and ensuing, the recovery of cost of
any defects covered during the period
6) If certain repairs/ damages of work are neglected by the contractor, the same
shall be carried out by the department at the risk and cost of the contractor and
cost of the same will be recovered from the amount of security deposit.
Considering the guarantee to be offered by the contractor, it is
requested that the contractor should thoroughly inspect the site of work and study
the site conditions before quoting for the work.
