the contractor who shall be responsible for making all payment due under the<br />

Act in case of accident.<br />

7. Petty items : All petty items occurring in the works and as found necessary shall<br />

be carried out as per standard specification book No. 1 and II as per the orders of<br />

Executive Engineer (E&M) or his representative.<br />

8. Damages to Public Property : The contractor is expected to carry out the work<br />

in such a manner as not to cause any damage to the public property. Increase<br />

any damage occurs to public property on account of negligence or otherwise by<br />

the contractor, he shall be fully responsible for making good the damages caused<br />

by him entirely at his cost.<br />

9. Safety of materials and recoveries : The contractor shall use the materials<br />

supplied to him by the department at free of cost very properly and<br />

economically. The contractor shall be responsible for proper handling and safe<br />

custody of materials so issued to him. The materials remaining unused after<br />

completion of work shall be returned by the contractor at the department’s store<br />

as directed. The department will accept only such materials as are in perfect<br />

condition. If any of the materials issued to the contractor are found<br />

short/damaged the cost therefore shall be recovered from the contractor at<br />

double the rate which it was purchased by the Department or the market rate<br />

prevailing, at that time, whichever is higher. The contractor shall maintain a day<br />

to day account of materials issued to him by the department and shall produce it<br />

to the Engineer in charge.<br />

10. Water supply : The contractor will make his own arrangements for water<br />

required for constructing purpose. However, if possible, required quantity of<br />

water for the purpose of construction and day to day use of labour etc. will be<br />

made available from the existing MIDC system. Necessary water connection will<br />

be given by MIDC as per water supply rules and regulations and all cost of<br />

materials and labours for providing and laying the lines and providing adequate<br />

storage etc are to be borne by the contractor. Water supply will be made<br />

available, if possible at the rate fixed by MIDC from time to time and these<br />

charges shall be paid monthly by the contractor.<br />
