Foreword<br />
The United States <str<strong>on</strong>g>Commissi<strong>on</strong></str<strong>on</strong>g> <strong>on</strong> <strong>Civil</strong> <strong>Rights</strong> was created by the <strong>Civil</strong><br />
<strong>Rights</strong> Act <strong>of</strong> 1957 as a bipartisan agency to study civil rights problems<br />
and report to the President and C<strong>on</strong>gress. Originally created for a 2-year<br />
term, it issued its first comprehensive report <strong>on</strong> September 8, 1959.<br />
On September 14, 1959, C<strong>on</strong>gress extended the <str<strong>on</strong>g>Commissi<strong>on</strong></str<strong>on</strong>g>'s life for<br />
another 2 years. This is the sec<strong>on</strong>d <strong>of</strong> five volumes <strong>of</strong> the <str<strong>on</strong>g>Commissi<strong>on</strong></str<strong>on</strong>g>'s<br />
sec<strong>on</strong>d statutory report.<br />
Briefly stated, the <str<strong>on</strong>g>Commissi<strong>on</strong></str<strong>on</strong>g>'s functi<strong>on</strong> is to advise the President<br />
and C<strong>on</strong>gress <strong>on</strong> c<strong>on</strong>diti<strong>on</strong>s that may deprive American citizens <strong>of</strong> equal<br />
treatment under the law because <strong>of</strong> their color, race, religi<strong>on</strong>, or nati<strong>on</strong>al<br />
origin. The <str<strong>on</strong>g>Commissi<strong>on</strong></str<strong>on</strong>g> has no power to enforce laws or correct any<br />
individual wr<strong>on</strong>g. Basically, its task is to collect, study, and appraise<br />
informati<strong>on</strong> relating to civil rights throughout the country, and to make<br />
appropriate recommendati<strong>on</strong>s to the President and C<strong>on</strong>gress for corrective<br />
acti<strong>on</strong>. The Supreme Court has described the <str<strong>on</strong>g>Commissi<strong>on</strong></str<strong>on</strong>g>'s<br />
statutory duties in this way:<br />
... its functi<strong>on</strong> is purely investigative and factfinding. It does not<br />
adjudicate. It does not hold trials or determine any<strong>on</strong>e's civil or<br />
criminal liability. It does not issue orders. Nor does it indict,<br />
punish, or impose any legal sancti<strong>on</strong>s. It does not make determinati<strong>on</strong>s<br />
depriving any<strong>on</strong>e <strong>of</strong> his life, liberty, or property. In short,<br />
the <str<strong>on</strong>g>Commissi<strong>on</strong></str<strong>on</strong>g> does not and cannot take any affirmative acti<strong>on</strong><br />
which will affect an individual's legal rights. The <strong>on</strong>ly purpose <strong>of</strong><br />
its existence is to find facts which may subsequently be used as the<br />
basis for legislative or executive acti<strong>on</strong>.<br />
Specifically, the <strong>Civil</strong> <strong>Rights</strong> Act <strong>of</strong> 1957, as amended, directs the<br />
<str<strong>on</strong>g>Commissi<strong>on</strong></str<strong>on</strong>g> to:<br />
• Investigate formal allegati<strong>on</strong>s that citizens are being deprived <strong>of</strong> their<br />
right to vote and have that vote counted by reas<strong>on</strong> <strong>of</strong> their color, race,<br />
religi<strong>on</strong>, or nati<strong>on</strong>al origin;<br />
• Study and collect informati<strong>on</strong> c<strong>on</strong>cerning legal developments which<br />
c<strong>on</strong>stitute a denial <strong>of</strong> equal protecti<strong>on</strong> <strong>of</strong> the laws under the C<strong>on</strong>stituti<strong>on</strong>;<br />
