Recommendati<strong>on</strong>s requiring the withholding <strong>of</strong> funds from States<br />
which are not completely desegregated would warrant serious c<strong>on</strong>siderati<strong>on</strong><br />
<strong>on</strong>ly if there were no other way to achieve c<strong>on</strong>formity with the<br />
C<strong>on</strong>stituti<strong>on</strong> without penalizing students. Many <strong>of</strong> the other recommendati<strong>on</strong>s<br />
in this report are designed to bring about desegregati<strong>on</strong><br />
without harming educati<strong>on</strong>.<br />
Thus I dissent from Recommendati<strong>on</strong> 2 because I believe it to be<br />
unnecessary and potentially punitive.<br />
Recommendati<strong>on</strong> 3.—That C<strong>on</strong>gress c<strong>on</strong>sider the advisability <strong>of</strong><br />
adopting measures to expedite the hearing and final determinati<strong>on</strong> <strong>of</strong><br />
acti<strong>on</strong>s brought in Federal courts to secure admissi<strong>on</strong> to publicly-c<strong>on</strong>trolled<br />
educati<strong>on</strong>al instituti<strong>on</strong>s without regard to race, color, religi<strong>on</strong> or<br />
nati<strong>on</strong>al origin.*<br />
Federal assistance to desegregating school districts<br />
Recommendati<strong>on</strong> 4.—That the C<strong>on</strong>gress enact legislati<strong>on</strong> authorizing a<br />
Federal agency, up<strong>on</strong> request, to provide technical or financial assistance<br />
to local school systems at any time within 5 years after the initiati<strong>on</strong> <strong>of</strong><br />
a desegregati<strong>on</strong> program, or to local citizens' groups attempting to help<br />
solve problems arising from such desegregati<strong>on</strong>, in any <strong>of</strong> the following<br />
ways: (i) financial aid to school districts <strong>on</strong> a 50-50 matching basis<br />
for the employment <strong>of</strong> social workers, or specialists in desegregati<strong>on</strong><br />
problems, or for inservice training programs for teachers or guidance<br />
counselors; (2) technical assistance to school districts or citizens' groups<br />
to train school pers<strong>on</strong>nel or community leaders in techniques useful in<br />
solving desegregati<strong>on</strong> problems, including the establishment <strong>of</strong> home<br />
study programs for the academically and culturally handicapped; provided,<br />
however, that the desegregati<strong>on</strong> program and its executi<strong>on</strong> shall<br />
have been found by the agency administering the program to meet<br />
c<strong>on</strong>stituti<strong>on</strong>al requirements.<br />
Recommendati<strong>on</strong> 5.—That the C<strong>on</strong>gress enact legislati<strong>on</strong> authorizing<br />
loans to local school districts from which State or local financial aid has<br />
been withdrawn as a result <strong>of</strong> desegregati<strong>on</strong>, or whose ability to borrow<br />
funds from commercial sources has been cut <strong>of</strong>f by State or local acti<strong>on</strong>,<br />
said loans to be repayable by the borrower up<strong>on</strong> the receipt <strong>of</strong> the State<br />
or local aid withheld or the restorati<strong>on</strong> <strong>of</strong> commercial credit.<br />
Recommendati<strong>on</strong> 6.—(a) That the President direct, or the C<strong>on</strong>gress<br />
enact legislati<strong>on</strong> authorizing, the <str<strong>on</strong>g>Commissi<strong>on</strong></str<strong>on</strong>g> <strong>on</strong> <strong>Civil</strong> <strong>Rights</strong>, if ex-<br />

the use <strong>of</strong> three-judge courts to expedite final determinati<strong>on</strong>s in desegregati<strong>on</strong><br />
cases at the college level. Since there are additi<strong>on</strong>al ways that<br />
desegregati<strong>on</strong> cases may be expedited, the <str<strong>on</strong>g>Commissi<strong>on</strong></str<strong>on</strong>g> has now framed<br />
its recommendati<strong>on</strong> in general terms and expanded it to include desegregati<strong>on</strong><br />
cases at the elementary and sec<strong>on</strong>dary school levels as well.<br />
