11. The Colleges<br />
In January <str<strong>on</strong>g>1961</str<strong>on</strong>g> the <str<strong>on</strong>g>Commissi<strong>on</strong></str<strong>on</strong>g> made its sec<strong>on</strong>d report to the President<br />
and C<strong>on</strong>gress in the field <strong>of</strong> educati<strong>on</strong>: Equal Protecti<strong>on</strong> <strong>of</strong> the<br />
Laws in Public Higher Educati<strong>on</strong>, igGo. 1 This traced the development<br />
<strong>of</strong> separate public colleges for Negroes in the latter half <strong>of</strong> the igth<br />
century, the role <strong>of</strong> the Federal Government in the establishment and<br />
financial support <strong>of</strong> such instituti<strong>on</strong>s, and certain related Federal policies<br />
as they affect equal protecti<strong>on</strong> <strong>of</strong> the laws.<br />
Three proposals were made. The first recommended that Federal<br />
funds be granted <strong>on</strong>ly to public instituti<strong>on</strong>s which do not discriminate<br />
<strong>on</strong> grounds <strong>of</strong> race, color, religi<strong>on</strong>, or nati<strong>on</strong>al origin. No executive or<br />
legislative acti<strong>on</strong> in this regard has been taken.<br />
The sec<strong>on</strong>d recommendati<strong>on</strong> dealt with the enforcement <strong>of</strong> c<strong>on</strong>stituti<strong>on</strong>al<br />
rights. The <str<strong>on</strong>g>Commissi<strong>on</strong></str<strong>on</strong>g> proposed that C<strong>on</strong>gress c<strong>on</strong>sider authorizing<br />
the use <strong>of</strong> three-judge courts in cases presenting substantial<br />
issues <strong>of</strong> fact as to denial <strong>of</strong> equal protecti<strong>on</strong> in public higher educati<strong>on</strong>.<br />
There has been no legislati<strong>on</strong> <strong>on</strong> this matter. In the <strong>University</strong><br />
<strong>of</strong> Georgia case, discussed hereafter, the <strong>on</strong>ly relevant case decided since<br />
the publicati<strong>on</strong> <strong>of</strong> the <str<strong>on</strong>g>Commissi<strong>on</strong></str<strong>on</strong>g>'s report, suit was filed in September<br />
1960 and the court denied a preliminary injuncti<strong>on</strong> that would have<br />
allowed the plaintiffs to attend the university immediately. Final decisi<strong>on</strong>,<br />
however, was quickly reached, and the plaintiffs were admitted<br />
to the university in January <str<strong>on</strong>g>1961</str<strong>on</strong>g>. The early admissi<strong>on</strong> <strong>of</strong> the plaintiffs<br />
was due in large measure to a change in State policy in the face<br />
<strong>of</strong> the Federal court's acti<strong>on</strong> (and in some degree to swift acti<strong>on</strong> by<br />
the United States Court <strong>of</strong> Appeals for the Fifth Circuit in vacating<br />
a stay granted by the district court). If a three-judge court had been<br />
available in this case, al<strong>on</strong>g the lines <strong>of</strong> the <str<strong>on</strong>g>Commissi<strong>on</strong></str<strong>on</strong>g>'s recommendati<strong>on</strong>,<br />
such a court might well have been more willing than the single<br />
judge to issue a preliminary injuncti<strong>on</strong> in September, with the result<br />
<strong>of</strong> even earlier admissi<strong>on</strong> <strong>of</strong> the plaintiffs. A new suit in Mississippi<br />
should cast further light <strong>on</strong> the potential usefulness <strong>of</strong> the <str<strong>on</strong>g>Commissi<strong>on</strong></str<strong>on</strong>g>'s<br />
recommendati<strong>on</strong>.<br />
The third recommendati<strong>on</strong> pointed out the need for acti<strong>on</strong> to alleviate<br />
academic handicaps resulting from inferior educati<strong>on</strong>al opportunities.<br />
