1. Introducti<strong>on</strong><br />
Our progress as a Nati<strong>on</strong> can be no swifter than our progress in<br />
educati<strong>on</strong>. Our requirements for world leadership, our hopes<br />
for ec<strong>on</strong>omic growth, and the demands <strong>of</strong> citizenship itself in an<br />
era such as this all require the maximum development <strong>of</strong> every<br />
young American's capacity. The human mind is our fundamental<br />
resource.<br />

The Supreme Court pointed out in Brown v. Board <strong>of</strong> Educati<strong>on</strong> <strong>of</strong><br />
Topeka, 1 or the School Segregati<strong>on</strong> Cases, that educati<strong>on</strong> is perhaps<br />
the most important modern functi<strong>on</strong> <strong>of</strong> State and local government.<br />
"In these days," the Court said, "it is doubtful that any child may<br />
reas<strong>on</strong>ably be expected to succeed in life if he is denied the opportunity<br />
<strong>of</strong> an educati<strong>on</strong>." 2 But, like all governmental functi<strong>on</strong>s, this <strong>on</strong>e must<br />
be carried out in c<strong>on</strong>formity with the C<strong>on</strong>stituti<strong>on</strong> which requires that<br />
educati<strong>on</strong> provided by State and local governments be available to all<br />
pers<strong>on</strong>s <strong>on</strong> equal terms.<br />
The heavy cost <strong>of</strong> discriminati<strong>on</strong> in the schools, both to those denied<br />
equal opportunity and to the Nati<strong>on</strong> as a whole, led the <str<strong>on</strong>g>Commissi<strong>on</strong></str<strong>on</strong>g><br />
in the Spring <strong>of</strong> 1958 to include public educati<strong>on</strong> in its studies. This<br />
decisi<strong>on</strong> rests <strong>on</strong> the authortity granted by the <strong>Civil</strong> <strong>Rights</strong> Act <strong>of</strong> 1957<br />
which directs the <str<strong>on</strong>g>Commissi<strong>on</strong></str<strong>on</strong>g> to "study and collect informati<strong>on</strong> c<strong>on</strong>cerning<br />
legal developments c<strong>on</strong>stituting a denial <strong>of</strong> equal protecti<strong>on</strong><br />
<strong>of</strong> the laws under the C<strong>on</strong>stituti<strong>on</strong>," and to "appraise the laws and<br />
policies <strong>of</strong> the Federal Government with respect to equal protecti<strong>on</strong><br />
<strong>of</strong> the laws under the C<strong>on</strong>stituti<strong>on</strong>." 3<br />
The <str<strong>on</strong>g>Commissi<strong>on</strong></str<strong>on</strong>g> has issued two previous reports <strong>on</strong> the denial <strong>of</strong><br />
c<strong>on</strong>stituti<strong>on</strong>al rights in the field <strong>of</strong> educati<strong>on</strong>. The first, a part <strong>of</strong> the<br />
Z 959 <strong>Report</strong>, dealt with public elementary and sec<strong>on</strong>dary schools. The<br />
sec<strong>on</strong>d, in January <str<strong>on</strong>g>1961</str<strong>on</strong>g>, was c<strong>on</strong>fined to public higher educati<strong>on</strong>. 4<br />
The present report returns to the subject <strong>of</strong> the first: denial <strong>of</strong> equal<br />
protecti<strong>on</strong> in public elementary and sec<strong>on</strong>dary schools.<br />
