to a board <strong>of</strong> arbitrators which sustained the ruling <strong>of</strong> the<br />
executive committee, and held that uni<strong>on</strong> funds cannot be used to<br />
support a school open <strong>on</strong>ly to white students nor to grant scholarships<br />
to its graduates when such a scholarship is not <strong>of</strong>fered to the<br />
graduates <strong>of</strong> other community high schools. The uni<strong>on</strong>, <strong>of</strong> course,<br />

105. Ordinance adopted <strong>on</strong> July 18, 1960, by the Board <strong>of</strong> Supervisors<br />
<strong>of</strong> Prince Edward County. The county treasurer <strong>of</strong> Prince Edward<br />
informed a representative <strong>of</strong> the <str<strong>on</strong>g>Commissi<strong>on</strong></str<strong>on</strong>g> that in 1960-61,<br />
1,614 affidavits were filed applying for tax credit for c<strong>on</strong>tributi<strong>on</strong>s<br />
totaling $56,866.22. He estimated that about 250 people own<br />
more than <strong>on</strong>e parcel, so that this represented 1,364 individuals—a<br />
number approximating the enrollment at the foundati<strong>on</strong>'s schools<br />
the same year. Since the county ordinance allows tax credits to pers<strong>on</strong>s<br />
making c<strong>on</strong>tributi<strong>on</strong> <strong>on</strong>ly to private schools located within the<br />
county, the Prince Edward County Foundati<strong>on</strong>, which is the <strong>on</strong>ly<br />
such private school, obviously was the recipient <strong>of</strong> all <strong>of</strong> these<br />
c<strong>on</strong>tributi<strong>on</strong>s.<br />
