12 Background The two parent properties total 3.0 hectares (7.5 acres). Both properties are flat with one dwelling and several out buildings which will be removed as part of the subdivision. There is one existing dwelling located on proposed Lot 4 (Map 1) that will be retained as part of the subdivision. The surrounding area is composed of large estate lots with single family dwellings, similar to the lots in this proposal. Official Community Plan Designation The subject properties and the surrounding area designated suburban in the Official Community Plan. No amendment to the Official Community Plan is required. Zoning The subject properties are zoned RU-1, Rural One zone which has a minimum parcel size of 1.8 hectares (4.44 acres). The area has been undergoing redevelopment over the past few years with a number of properties in the area being rezoned to RS-2 One Unit Suburban Residential zone to facilitate subdivision into parcels with minimum parcel sizes of 0.36 hectares (0.88 acre). Communitygontribution In accordance with Council Policy LAN. 40 — COMMUNITY AMENITY CONTRIBUTIONS, the applicant has volunteered $9,550.00 for the creation of five ( 5) new parcels. As there is already 2 parcels there are only 5 new parcels being created. Tree Retention and Replanting The tree survey attached as Appendix 2 identifies five (5) trees located within the proposed septic fields on proposed Lots 3 and 4 that will need to be removed as part of the subdivision. As these are large suburban lots, with few trees, no other trees require removal as part of the subdivision. Thus, as the requirement to plant 2 trees per lot for a total of fourteen (14) trees is greater than the five (5) trees that will be removed, the developer will be required to plant the 14 trees prior to final subdivision approval. Parkland A referral was sent to the Parks, Recreation & Culture Department and their recommendation is to accept cash in lieu, as the Mission Sports Park is down the road and provides lots recreation opportunities. Internal Comments The application was reviewed at the Pre-application meeting with the developer, Planning and Engineering. The Engineering Department has reviewed the proposal with comments outlined in the Engineering Department Rezoning Comments attached. External Referrals There are no watercourses on or adjacent to the subject properties, and therefore, there will be no referral to the Department of Fisheries and Oceans. However, the usual external referrals will be made to the various utility agencies as part of the subdivision process.
13 Road Construction As shown on Plan 3, Kenny Avenue will be extended to connect to Nelson Street. Public Hearing Information Package In accordance with Council Policy LAN.50 — PRE-PUBLIC HEARING INFORMATION PACKAGES, a package of information will be produced containing material related to this development application. Requirements Prior to Adoption of the Zone Amending Bylaw • Receipt of the Community Amenity contribution in the amount of S9,550.00. A letter of credit for installing and maintaining trees identified the Tree Survey. Engineering requirements attached • Any other items that Council may require resulting from the Public Hearing or Council consideration of the application. Staff recommends that the rezoning proposal proceed to Public Hearing on July 27, 2009.
