16.2.4 The committee will have <strong>the</strong> capacity to monitor <strong>the</strong> implementation <strong>of</strong> <strong>the</strong> agreed<br />

recommendations <strong>and</strong> outcomes. The committee may also discuss any o<strong>the</strong>r issues agreed<br />

by <strong>the</strong> committee.<br />

16.3 Union rights<br />

The parties agree to continue on-going consultation between <strong>the</strong> Departmental management <strong>and</strong><br />

<strong>the</strong> Union.<br />

16.3.1 Representative Rights<br />

The Employer recognises <strong>the</strong> legitimate right <strong>of</strong> <strong>the</strong> Union to represent those<br />

Employees who are members, or eligible to become members.<br />

An accredited Union delegate shall be allowed reasonable time during working hours to<br />

consult with members or Employees eligible to become members on employment<br />

matters affecting Employees provided that such consultation:<br />

(i) will not adversely affect <strong>the</strong>ir ability to perform <strong>the</strong>ir duties;<br />

(ii) does not disturb or interfere with <strong>the</strong>ir workplace or <strong>the</strong> workplace in which <strong>the</strong><br />

consultation occurs; <strong>and</strong><br />

(iii) has been approved by <strong>the</strong> relevant manager in advance <strong>of</strong> <strong>the</strong> activity.<br />

Such approval shall not be unreasonably withheld.<br />

16.3.2 Right <strong>of</strong> Entry<br />

Subject to <strong>the</strong> FWA right <strong>of</strong> entry requirements, a duly accredited Union representative will<br />

observe all <strong>the</strong> usual courtesies including giving prior notice when entering or seeking to enter<br />

<strong>the</strong> Department’s premises <strong>and</strong> will not disturb or interfere with any work being carried out<br />

on <strong>the</strong> premises at any time while <strong>the</strong>y are on <strong>the</strong> premises.<br />

16.3.3 Union Training Leave<br />

For <strong>the</strong> purpose <strong>of</strong> assisting Employees to underst<strong>and</strong> <strong>the</strong>ir rights <strong>and</strong> entitlements<br />

under this Agreement <strong>and</strong> improving industrial relations, <strong>the</strong> CEO shall, subject to <strong>the</strong><br />

provisions <strong>of</strong> this clause, provide an employee who is a nominated union delegate with<br />

up to five days’ paid leave per annum to attend union training courses conducted by <strong>the</strong><br />

Union or approved by <strong>the</strong> Union.<br />

The approval for an employee to attend a training course shall be subject to <strong>the</strong><br />

operational requirements <strong>of</strong> <strong>the</strong> Department.<br />

Such approval shall not be unreasonably withheld.<br />

An employee seeking to take union training leave must:<br />

a. Have completed at least twelve months’ continuous service prior to taking<br />

union training leave; <strong>and</strong><br />
