23.8 If a decision is made under paragraph 23.6(a) or paragraph 23.6(b) <strong>the</strong> Employee may appeal<br />

where <strong>the</strong> increment has been deferred for greater than <strong>the</strong> period in sub-clause 23.6 (a) on<br />

<strong>the</strong> basis <strong>of</strong> one or more <strong>of</strong> <strong>the</strong> following reasons:<br />

(a)<br />

(b)<br />

(c)<br />

This clause has not been adhered to; or<br />

The decision was made to punish or harass <strong>the</strong> Employee; or<br />

Natural justice has not been afforded to <strong>the</strong> Employee.<br />

23.9 Any appeal under sub-clause 23.8 will be heard <strong>and</strong> determined by a panel constituted in<br />

accordance with <strong>the</strong> guidelines for constituting a Promotion Appeal Board.<br />

23.10 In all cases where an increment is deferred, <strong>the</strong> date to which it is deferred will become <strong>the</strong><br />

anniversary date for <strong>the</strong> purposes <strong>of</strong> <strong>the</strong> next increment.<br />

23.11 The Commissioner will notify <strong>the</strong> Union <strong>of</strong> <strong>the</strong> acceptance <strong>of</strong> any performance management<br />

system for <strong>the</strong> purposes <strong>of</strong> sub-clause 23.3 prior to that system being used for deferral <strong>of</strong><br />

increments.<br />

24. Pr<strong>of</strong>essional Development Allowance<br />

24.1 An Employee, excluding casuals, who has been employed with <strong>the</strong> Department for <strong>the</strong><br />

required qualifying period will be paid a Pr<strong>of</strong>essional Development Allowance annually to<br />

<strong>of</strong>fset approved pr<strong>of</strong>essional development costs. The qualifying period <strong>and</strong> amounts are as<br />

specified in <strong>the</strong> following table:<br />

24.2 The allowance amounts outlined in sub clause 24.1 will be adjusted from 1 January each<br />

year by <strong>the</strong> Darwin Consumer Price Index based on <strong>the</strong> September quarter for <strong>the</strong> previous<br />

year.<br />

24.3 The allowance does not count as salary for any purpose.<br />

24.4 The qualifying period <strong>of</strong> continuous service as a nurse for <strong>the</strong> allowance will be determined<br />

as at 30 August <strong>of</strong> each year with payment <strong>of</strong> <strong>the</strong> allowance to be made as soon as<br />

practicable after that date.<br />
