4.4 An Employee who is called on emergency duty may, where it is essential for health <strong>and</strong><br />

safety, be relieved from <strong>the</strong> Employee’s next scheduled regular duty without deduction from<br />

wages, for a period not exceeding <strong>the</strong> number <strong>of</strong> hours <strong>of</strong> <strong>the</strong> emergency duty worked. The<br />

period <strong>of</strong> relief from duty will not extend into a second period <strong>of</strong> regular duty.<br />

4.5 The provisions <strong>of</strong> this clause do not apply to an Employee whose commencement time <strong>of</strong><br />

regular duty is altered to meet an emergency.<br />

5. Restrictive Duty<br />

5.1 An Employee may be directed to be contactable <strong>and</strong> to be available to perform extra duty<br />

outside <strong>of</strong> <strong>the</strong> Employee’s ordinary hours <strong>of</strong> duty, subject to payment under this clause.<br />

5.2 Payment will be made subject to <strong>the</strong> following conditions:<br />

(a)<br />

(b)<br />

(c)<br />

(d)<br />

Unless o<strong>the</strong>rwise approved by <strong>the</strong> Commissioner, an Employee in a classification at or<br />

above Nurse 6 level is not eligible to receive payment;<br />

The restrictive duty situation is imposed by prior written direction, or is subsequently<br />

approved in writing;<br />

The provisions <strong>of</strong> clause 4 (Emergency Duty) will not apply where an Employee is<br />

recalled to duty while on restrictive duty;<br />

An Employee who does not maintain a required degree <strong>of</strong> readiness while on restrictive<br />

duty will not be eligible to receive payment.<br />

5.3 Payment rates<br />

(a)<br />

An Employee who is required to remain contactable <strong>and</strong> available to perform extra duty<br />

outside <strong>of</strong> <strong>the</strong> Employee’s ordinary hours <strong>of</strong> duty will, subject to sub-clause 5.2, be paid<br />

an allowance in addition to salary at a rate for <strong>the</strong> type <strong>of</strong> restrictive duty as follows:<br />

i. On call<br />

An Employee who is instructed prior to ceasing ordinary duty to be on restrictive<br />

duty will be paid at <strong>the</strong> rate specified in accordance with clause 31 (On-call<br />

Allowance) in Part 3 <strong>of</strong> this Agreement.<br />

ii. St<strong>and</strong> by<br />

An Employee who is instructed prior to ceasing ordinary duty to be on restrictive<br />

duty <strong>and</strong> to remain at <strong>the</strong> Employee’s home <strong>and</strong> available for immediate recall<br />

to duty: 50% <strong>of</strong> <strong>the</strong> Employee’s ordinary rate <strong>of</strong> salary for <strong>the</strong> proportion <strong>of</strong> <strong>the</strong><br />

period <strong>of</strong> restriction calculated in accordance with paragraph (b).<br />

iii. Home duty<br />
