44. Part-Time Employment<br />

44.1 (a) Subject to sub-clause 44.1 b), part-time employment arrangements for Employees are<br />

those outlined in Employment Instruction 14 <strong>and</strong> this clause.<br />

(b) Employees employed in <strong>the</strong>ir substantive position on a part-time basis prior to 1<br />

February 2004, <strong>and</strong> who remain continuously employed on a part-time basis, will retain<br />

<strong>the</strong> employment arrangements set out in Commissioner Determinations Number 4 <strong>and</strong><br />

115 <strong>of</strong> 1984 up until three months after <strong>the</strong> commencement <strong>of</strong> this Agreement. Three<br />

months after <strong>the</strong> commencement <strong>of</strong> this Agreement, <strong>the</strong> part –time employment<br />

arrangements for <strong>the</strong>se Employees will be in line with sub-clause 44.1 (a).<br />

44.2 No Employee who is currently employed on a full-time basis will be required to convert to<br />

part-time employment or transfer without <strong>the</strong>ir consent to enable part-time employment.<br />

44.3 At <strong>the</strong> time <strong>of</strong> engagement, or <strong>of</strong> conversion from full-time employment, <strong>the</strong> employer <strong>and</strong><br />

<strong>the</strong> Employee will agree in writing a regular pattern <strong>of</strong> part-time work, specifying at least <strong>the</strong><br />

hours worked each day, which days <strong>of</strong> <strong>the</strong> week <strong>the</strong> employee will work <strong>and</strong> <strong>the</strong> actual<br />

starting <strong>and</strong> finishing times each day.<br />

44.4 Changes to a part-time Employee's agreed hours originally established under sub clause 44.3<br />

may be made by mutual agreement between <strong>the</strong> Department <strong>and</strong> <strong>the</strong> Employee <strong>and</strong><br />

recorded in writing.<br />

44.5 The span <strong>of</strong> hours during which a part-time Employee may work <strong>the</strong>ir agreed hours will be<br />

<strong>the</strong> same span applicable to full-time Employees.<br />

44.6 Subject to sub-clause 33.3, an Employee will be liable to be called for duty at any time that<br />

he or she is required. Part-time Employees will not work more than 64 hours per fortnight<br />

unless operational needs apply.<br />

44.7 Overtime will only be paid for work performed:<br />

(a)<br />

(b)<br />

(c)<br />

(d)<br />

Outside <strong>the</strong> normal span <strong>of</strong> hours as specified in clause 32.1, except where <strong>the</strong><br />

Employee is a shift worker; or<br />

In excess <strong>of</strong> any daily maximum hours specified in a clause 6.1 b(ii) <strong>of</strong> Schedule 2 to this<br />

Agreement; or<br />

As restrictive duty or emergency duty as defined in <strong>the</strong> clauses 4 <strong>and</strong> 5 <strong>of</strong> Schedule 2; or<br />

After working in excess <strong>of</strong> 64 hours per fortnight.<br />

44.8 Changes to <strong>the</strong> part-time hours worked made in accordance with sub-clause 44.3 will not<br />

break <strong>the</strong> period <strong>of</strong> continuous part-time employment for <strong>the</strong> purposes <strong>of</strong> sub-clause<br />

44.1(b).<br />
