(d) (e) (f) (g) Any part of a period of restrictive duty for which the Employee receives another payment will not be included for calculating restrictive duty allowance. An Employee who is on restrictive duty and who is required to perform duty, but is not required to be recalled to a place of work, will be paid overtime, subject to a one hour minimum payment. An Employee who is on restrictive duty and who is recalled to duty at a place of work will be paid in accordance with the relevant overtime provisions, subject to a one hour minimum payment. Notwithstanding these payment rate provisions, an Employee who is placed in on restrictive duty outside of the Employee’s ordinary hours of duty may be paid at an alternative rate approved by the Commissioner, having regard to the circumstances of the restriction situation. 5.4 Salary rate (a) (b) (c) An Employee’s salary for the purposes of calculation of the restrictive duty allowance will include higher duties allowance and any other allowances in the nature of salary. Where approval has been made for payment under clause 5 (restrictive duty) to an Employee in a classification of N6 or above, the annual salary component of the formula at paragraph (c) below will be the maximum annual salary payable to an Administrative Officer 6. The hourly rate of payment will be calculated as follows: Annual salary X 6 X % of salary prescribed in paragraph 5.3 313 Prescribed weekly hours before overtime is payable 6. Overtime 6.1 General conditions (a) (b) Overtime is worked by prior direction or, if circumstances do not permit prior direction, is subsequently approved in writing. Unless otherwise provided for in clause 4 (Shift work) of Schedule 1, duty is considered overtime where it is performed on: 86 NTPS NURSES AND MIDWIVES’ 2011-2014 Enterprise Agreement
i. Monday to Friday outside the span of ordinary hours; ii. Monday to Friday during the span of ordinary hours but beyond the length of time the Employee is normally required to work on the day concerned; or iii. a Saturday, Sunday or public holiday. (c) (d) (e) An Employee’s salary for the purpose of calculation of overtime will include higher duties and other allowances in the nature of salary. Overtime is calculated to the nearest quarter of an hour of the total amount of overtime worked in a fortnightly period. The hourly rate for overtime payment will be ascertained by applying the following formulae: Time and a half rate: Annual salary x 6 x 3 313 Prescribed weekly hours before overtime is payable 2 Double time rate: Annual salary x 6 x 2 313 Prescribed weekly hours before overtime is payable 1 Double time and a half rate: Annual salary x 6 x 5 313 Prescribed weekly hours before overtime is payable 2 (f) (g) In applying the relevant formula at paragraph (e), prescribed weekly hours before overtime is payable are 38, with the exception of overtime worked on Sunday and outside ordinary hours on public holidays by Employees whose weekly hours are 36.75 where prescribed weekly hours before overtime is payable are 36.75. Unless authorised by the Commissioner, an Employee in a classification the minimum salary of which exceeds the maximum salary of the classification of Administrative Officer 6 is not eligible to receive overtime payment.
