i. A review, initiated by ei<strong>the</strong>r <strong>the</strong> employer or Employee, <strong>of</strong> a deferral or refusal<br />
imposed pursuant to sub-clause 2.2(b) <strong>and</strong>/or<br />
ii. <strong>the</strong> lifting <strong>of</strong> such a deferral or refusal at <strong>and</strong> operative from such date where<br />
circumstances have changed such that <strong>the</strong> Employee appropriately falls within<br />
<strong>the</strong> terms specified for his or her next pay point (as defined); or<br />
(c)<br />
An appeal or review, for <strong>the</strong> purposes <strong>of</strong> this subclause, will be undertaken <strong>and</strong> resolved<br />
in accordance with clause 13 <strong>of</strong> this Agreement.<br />
2.4 Accelerated advancement<br />
(a)<br />
Subject to sub-paragraph (b) hereunder, an Employee (o<strong>the</strong>r than an Enrolled Nurse<br />
appointed in his or her first year <strong>of</strong> experience at pay point Y2 as defined in subparagraph<br />
2.1(g)i1 <strong>of</strong> this Schedule), will be entitled to accelerated advancement by one<br />
pay point:<br />
i. for possession <strong>of</strong> a post enrolment qualification recognised by <strong>the</strong> employer;<br />
or<br />
ii.<br />
iii.<br />
on completion <strong>of</strong> a post enrolment course <strong>of</strong> at least six months duration; or<br />
where such an Employee is required to perform duties to which such<br />
training is directly relevant.<br />
(b)<br />
An Employee who has advanced in accordance with sub-paragraph (a) above will not be<br />
entitled to fur<strong>the</strong>r accelerated advancement pursuant to this subclause.<br />
2.5 Recognition <strong>of</strong> training, experience <strong>and</strong> skill<br />
All relevant training, experience <strong>and</strong> skills as an Enrolled Nurse or trained assistant in<br />
nursing, o<strong>the</strong>r than such experience predating any break <strong>of</strong> five or more consecutive years<br />
will be counted for <strong>the</strong> purposes <strong>of</strong> determining <strong>the</strong> appropriate pay point on appointment.<br />
3. Hours <strong>of</strong> Duty<br />
3.1 The ordinary hours <strong>of</strong> duty will be an average 76 per fortnight.<br />
3.2 The ordinary hours <strong>of</strong> work, except for a Registered Nurse working in a school, will be an<br />
average <strong>of</strong> 38 per week <strong>and</strong> will not exceed 152 hours in 28 consecutive days.<br />
3.3 For a Registered Nurse working in a school, <strong>the</strong> ordinary hours <strong>of</strong> work will be 38 per week,<br />
or an average <strong>of</strong> 38 hours per week averaged over a period <strong>of</strong> 46 weeks.<br />
3.4 The ordinary hours <strong>of</strong> duty will, wherever reasonably practicable, be worked so that:<br />
(a)<br />
in any week not more than five shifts are exceeded; or<br />
