4.6 The airfare entitlement referred to in sub-clause 4.5 must be used within 90 days after <strong>the</strong><br />

date <strong>of</strong> retrenchment, unless o<strong>the</strong>rwise approved by <strong>the</strong> Commissioner.<br />

5. Notice <strong>of</strong> Transfer or Termination <strong>of</strong> Employment<br />

5.1 An Employee must be given 4 weeks formal notice that he or she will be transferred to a<br />

lower salary or employment will be terminated when:<br />

(a)<br />

(b)<br />

<strong>the</strong> relevant period <strong>of</strong> notice in clause 3 has expired <strong>and</strong> <strong>the</strong> Employee cannot be placed<br />

in o<strong>the</strong>r suitable employment;<br />

<strong>the</strong> relevant period <strong>of</strong> notice in clause 3 has expired <strong>and</strong> <strong>the</strong> training for alternative<br />

employment cannot be arranged.<br />

5.2 An Employee over <strong>the</strong> age <strong>of</strong> 45 years is entitled to 5 weeks formal notice that he or she will<br />

be transferred to a lower salary or will be terminated from employment.<br />

6. Leave <strong>and</strong> Expenses to Seek Employment<br />

For <strong>the</strong> purpose <strong>of</strong> attending employment interviews, an Employee who has received notice<br />

in accordance with clauses 3 or 5 is entitled:<br />

(a)<br />

(b)<br />

to reasonable leave with full pay; <strong>and</strong><br />

to reasonable travelling <strong>and</strong> incidental expenses necessary to attend an interview<br />

where those expenses are not met by <strong>the</strong> prospective employer.<br />

7. Election to Terminate Employment or be Transferred<br />

7.1 With <strong>the</strong> approval <strong>of</strong> <strong>the</strong> Commissioner, an Employee who has received notice in accordance<br />

with clauses 3 or 5 <strong>of</strong> this Schedule may elect to terminate employment or be transferred<br />

before <strong>the</strong> expiry date <strong>of</strong> <strong>the</strong> notice period. The date elected <strong>the</strong>n becomes <strong>the</strong> date <strong>of</strong><br />

termination <strong>of</strong> employment or transfer.<br />

7.2 Where <strong>the</strong> Commissioner approves an election to terminate employment, <strong>the</strong> Employee will<br />

be entitled to receive payment in lieu <strong>of</strong> salary for <strong>the</strong> unexpired portion <strong>of</strong> <strong>the</strong> notice<br />

period. This payment includes Nor<strong>the</strong>rn Territory Allowance where it is applicable.<br />

7.3 An Employee who has declined an invitation to volunteer retrenchment prior to clauses 3 or<br />

5 <strong>of</strong> this Schedule being invoked, is not entitled to receive a greater payment under<br />

subclause 7.2 <strong>of</strong> this Schedule than <strong>the</strong> Employee would have been entitled to receive had<br />

he or she elected to be voluntarily retrenched.<br />

8. Provision <strong>of</strong> Income Maintenance<br />

An Employee will be able to receive maintenance <strong>of</strong> income payments in accordance with clauses 9,<br />

10 <strong>and</strong> 11 <strong>of</strong> this Schedule where his or her employment is terminated or where he or she has been<br />

transferred to a lower designation <strong>and</strong> salary.<br />
