each cashing out <strong>of</strong> a particular amount <strong>of</strong> paid recreation leave must be by a separate<br />

agreement in writing between <strong>the</strong> CEO <strong>and</strong> Employee;<br />

<strong>the</strong> Employee must be paid at least <strong>the</strong> full amount that would have been payable to <strong>the</strong><br />

Employee had <strong>the</strong> Employee taken <strong>the</strong> leave that <strong>the</strong> Employee has forgone; <strong>and</strong><br />

a minimum <strong>of</strong> five (5) days to be cashed-out on any occasion.<br />

56.9 Illness during Leave<br />

Where an Employee becomes ill during a period <strong>of</strong> recreation leave <strong>and</strong> <strong>the</strong> illness is supported by<br />

documentary evidence as set out in clause 55 (Personal Leave), <strong>the</strong> CEO may grant personal leave<br />

<strong>and</strong> authorise <strong>the</strong> equivalent period <strong>of</strong> recreation leave to be re-credited.<br />

56.10 Payment in lieu<br />

Where an Employee ceases employment, o<strong>the</strong>r than by death, <strong>the</strong> Employee is entitled<br />

to payment in lieu <strong>of</strong> any available recreation leave entitlement.<br />

Where an Employee dies, or after consideration <strong>of</strong> all <strong>the</strong> circumstances <strong>the</strong><br />

Commissioner has directed that an Employee will be presumed to have died on a<br />

particular date, <strong>the</strong> CEO may authorise payment in lieu <strong>of</strong> <strong>the</strong> Employee’s remaining<br />

recreation leave entitlement:<br />

56.11 Christmas Closedown<br />

i. to <strong>the</strong> Employee’s legal personal representative; or<br />

ii. when authorised by <strong>the</strong> Employee’s legal personal representative, to<br />

ano<strong>the</strong>r person or persons at <strong>the</strong> CEO’s discretion.<br />

56.11.1 The CEO will consult with relevant Employees in <strong>the</strong> event that <strong>the</strong> Department, or part<br />

<strong>of</strong> <strong>the</strong> Department, will be closed down for a nominated period. The closedown will<br />

occur provided that:<br />

(a) At least three (3) months notice in writing is given to Employees prior to <strong>the</strong><br />

closedown period; <strong>and</strong><br />

(b) The nominated period falls between 25 December <strong>and</strong> 1 January.<br />

56.11.2 Closedown may apply to part <strong>of</strong> <strong>the</strong> Department where <strong>the</strong> CEO decides to operate on<br />

minimal staffing levels for <strong>the</strong> purposes <strong>of</strong> providing essential services during a<br />

closedown period. This may occur subject to <strong>the</strong> CEO:<br />

Consulting with Employees regarding what staffing resources are required for <strong>the</strong><br />

period <strong>and</strong> calling for volunteers to cover <strong>the</strong> closedown period in <strong>the</strong> first instance; or<br />

If no volunteers are forthcoming, directing Employees with a least two (2) months<br />

notice to cover <strong>the</strong> closedown period.<br />
