4. Definitions For the purposes of this Agreement: (a) (b) (c) (d) “Agency” means an agency as defined in the PSEM Act; “Agreed Hours” means where the Employer and the Employee will agree in writing on a regular pattern of part-time work, specifying at least the hours worked each day, which days of the week the employee will work and the actual starting and finishing times each day; “Agreement” means the Northern Territory Public Sector Nurses’ 2011-2014 Enterprise Agreement; “FWA” means Fair Work Australia; (e) “FW Act” means Fair Work Act 2009; (f) “CEO” means the Chief Executive Officer of the Department of Health; (g) “Commencement date” means the date as determined under clause 5; (h) (i) (j) (k) (l) (m) (n) (o) (p) (q) “Commissioner” means the Commissioner for Public Employment in the Northern Territory; “Compulsory transferee” means an Employee who was compulsorily transferred to the Northern Territory Public Service from the Commonwealth Public Service; or the former Northern Territory Public Service under the provisions of section 38 or 40 of Part VI of the Public Service Act 1976; “Department” means the Department of Health; “Employee” means a nurse or midwife of the Northern Territory Public Sector employed under PSEM Act and holding a classification as specified in clause 20; “Employee representative” means a representative chosen by an Employee, which may be a Union representative; “NES” means the National Employment Standard provisions under the Fair Work Act 2009; “NTPS” means the Northern Territory Public Sector; “PSCC” means the Public Sector Consultative Council constituted under the PSEM Act; “PSEM Act” means the Northern Territory Public Sector Employment and Management Act and includes the Regulations, By-laws, Employment Instructions and Determinations made under that Act; “Union” means the Australian Nursing Federation. 5 NTPS NURSES AND MIDWIVES’ 2011-2014 Enterprise Agreement
