A. not less than 14 days before <strong>the</strong> proposed day <strong>of</strong> <strong>the</strong> placement in <strong>the</strong> case <strong>of</strong><br />

adoption leave taken under paragraph (c)(i) to (iii); <strong>and</strong><br />

B. not less than 10 weeks before <strong>the</strong> first day <strong>of</strong> <strong>the</strong> proposed leave in <strong>the</strong> case <strong>of</strong><br />

adoption leave taken under paragraphs (b)(i) to (iii) <strong>and</strong> (c)(iv) to (v).<br />

(iii) before <strong>the</strong> Employee begins a period <strong>of</strong> adoption leave:<br />

A. a statement from <strong>the</strong> adoption Agency stating <strong>the</strong> day when <strong>the</strong> placement is<br />

expected to start;<br />

B. in <strong>the</strong> case <strong>of</strong> adoption leave taken under paragraphs (b)(i) to (iii) <strong>and</strong> (c)(iv) to (v)<br />

a statutory declaration stating that <strong>the</strong> Employee intends to be <strong>the</strong> child’s<br />

primary care-giver at all times while on adoption leave.<br />

The Employee will not be in breach <strong>of</strong> paragraph (d) if <strong>the</strong> failure to give <strong>the</strong> required<br />

period <strong>of</strong> notice is because <strong>the</strong> Employee is not given sufficient notice <strong>of</strong> <strong>the</strong> expected<br />

day <strong>of</strong> placement to enable compliance, or any o<strong>the</strong>r compelling circumstance.<br />

Where an Employee has commenced a period <strong>of</strong> adoption leave <strong>and</strong> <strong>the</strong> adoption is<br />

discontinued for any reason (including <strong>the</strong> death <strong>of</strong> <strong>the</strong> child), <strong>the</strong> entitlement to<br />

adoption leave may continue for maximum period <strong>of</strong> 52 weeks from <strong>the</strong> date <strong>of</strong><br />

commencement <strong>of</strong> leave, unless <strong>the</strong> Employee elects to resume duty, in which case <strong>the</strong><br />

provisions <strong>of</strong> sub-clause 53.14 apply.<br />

Subject to paragraph (d), where an Employee exercising adoption leave under<br />

paragraph (b) (i) to (iii) adopts ano<strong>the</strong>r child during <strong>the</strong> period <strong>of</strong> leave, <strong>the</strong> period <strong>of</strong><br />

leave may be extended up to three (3) years from <strong>the</strong> date <strong>of</strong> placement <strong>of</strong> <strong>the</strong> child<br />

relating to <strong>the</strong> second adoption.<br />

A casual Employee is entitled to:<br />

(i) Up to two (2) days <strong>of</strong> unpaid pre-adoption leave to attend any interviews or<br />

examinations required in order to obtain approval for <strong>the</strong> employee’s adoption <strong>of</strong> a<br />

child; <strong>and</strong><br />

(ii) The leave may be taken as:<br />

A. a single continuous period <strong>of</strong> up to two (2) days; or<br />

B. any separate periods to which <strong>the</strong> employee <strong>and</strong> CEO agree.<br />

(iii) Notice <strong>and</strong> evidence requirements:<br />

A. <strong>the</strong> notice must be given to <strong>the</strong> CEO as soon as practicable (which may be a time<br />

after <strong>the</strong> leave has started); <strong>and</strong><br />

B. <strong>the</strong> notice must advise <strong>the</strong> CEO <strong>of</strong> <strong>the</strong> period, or expected period, <strong>of</strong> <strong>the</strong> leave.<br />

(iv) An employee who has given his or her CEO notice <strong>of</strong> <strong>the</strong> taking <strong>of</strong> unpaid pre-adoption<br />

leave must, if required by <strong>the</strong> CEO, provide evidence that would satisfy a reasonable<br />

person that <strong>the</strong> leave is taken to attend an interview or examination as required in<br />

order to obtain approval for employee’s adoption <strong>of</strong> a child.<br />
