2.6.3 Courts Martial<br />

<strong>The</strong> Constitution and the Kenya Defence Forces Act give a court<br />

martial power to try any person subject to the Act for any offence<br />

the court martial has jurisdiction over, and to award any punishment<br />

provided by law for it.<br />

2..6.4 Tribunals<br />

<strong>The</strong> Constitution, under Article 169 (1) (d), moved responsibility for all<br />

tribunals that were previously under the Executive to the supervision<br />

of the <strong>Judiciary</strong>. <strong>The</strong>re are at least 17 Tribunals (See Annex 6). In the<br />

past year, the <strong>Judiciary</strong> has taken over the Co-operatives Tribunal<br />

and the Political Parties Dispute Resolution Tribunal. <strong>The</strong> <strong>Judiciary</strong> will<br />

progressively assume responsibility of the other Tribunals in the future.
