NATIONAL COUNCIL FOR LAW REPORTING<br />

8.1. Overview<br />

<strong>The</strong> National Council for Law Reporting Act, 1994 established<br />

the Council and mandated it to publish the Kenya Law Reports<br />

and related publications; to revise, consolidate and publish the<br />

Laws of Kenya and to perform such other functions as may be<br />

conferred by statute.<br />

Emerging from decades of a culture of not reporting legal<br />

decisions, the National Council for Law Reporting (NCLR) has<br />

made great strides in recording and publishing existing and<br />

emerging jurisprudence.<br />

<strong>The</strong> Constitution requires the <strong>Judiciary</strong> to develop jurisprudence<br />

in order to assert its authority and command the respect and<br />

legitimacy of the public and its peers. Without the timeous<br />

reporting of judgments, rulings and decisions of the courts, it is<br />

arduous to build jurisprudence.<br />

With the support and advice of its leadership and membership<br />

NCLR continues to adopt strategies to re-engineer its editorial<br />

approach to ensure that it “extracts the essence of juristic thought<br />

and to lay it out as one of the beacons for the legal path for<br />

conflict resolution in the advancement of civilized society”.<br />

Over the years, the Council has bolstered its financial, human and<br />

infrastructural resources and developed a specialized set of legal<br />

reference materials highlighting emerging jurisprudence on the<br />

interpretation of the Constitution particularly on the Elections, Bill<br />

of Rights and Leadership and Integrity.<br />

8.2 Achievements and Awards<br />

NCLR keeps abreast of technological advances and regularly<br />

generates new and innovative services such as the ‘KLR<br />

Case Updates’, which provide a weekly synopsis of Kenyan<br />

jurisprudence, ‘CaseBack’, a service that informs a judicial<br />

officer once his or her decision has been considered on appeal,<br />

review or otherwise by another court; and Wakilishare, an open
