6.5 Finance and Resource Development – 2011/12 Management<br />
Initiatives<br />
In 2011/12, the finance and resource development agenda was<br />
limited to a number of foundation-building initiatives that were<br />
focused on the wider, medium-term JTF agenda. Five major<br />
initiatives are highlighted in this section of the report.<br />
6.5.1 Initial Steps to Operationalise the <strong>Judiciary</strong> Fund within a<br />
modern PFM Framework for the <strong>Judiciary</strong><br />
With the passing of the Judicial Service Act in early 2011 in<br />
line with the Constitution, the <strong>Judiciary</strong> Fund is now legally in<br />
force. <strong>The</strong> year 2011/12 was devoted to the development of<br />
regulations to guide the operations and administration of the<br />
Fund. <strong>The</strong>se regulations have now been gazetted and are now<br />
in force. Supporting this effort, a series of consultancies have<br />
been undertaken, and are ongoing, to establish a modern PFM<br />
framework for the <strong>Judiciary</strong> based on the recommendations<br />
of past reports, and the present imperative of transformation.<br />
This has included the exploration of potential ICT solutions that<br />
will support the integration of court and case work with court<br />
registries, human resource management and end-to-end public<br />
financial management functions from planning and budgeting<br />
to accounting, reporting, audit and evaluation.<br />
6.5.2 Enhanced Planning, Budgeting and Resource Mobilisation<br />
Recognising the enormous investment needs of the <strong>Judiciary</strong><br />
Transformation Framework, significant effort was made to secure<br />
an improved budget for the <strong>Judiciary</strong> for 2012/13, involving a mix<br />
of technical and political efforts, and reflecting the “science”<br />
and “art” of budgeting. A record KSh15.9 billion budget for the<br />
<strong>Judiciary</strong> was eventually secured in June 2012 and is currently<br />
under implementation.<br />
In addition, the outline of a comprehensive Programming-<br />
Planning-Budgeting-Results (PPBR) framework for the <strong>Judiciary</strong>;<br />
one that links policy, programming and planning, to budgeting,<br />
execution and results; is beginning to emerge. This framework<br />
is currently helping to guide the <strong>Judiciary</strong>’s work in 2013/14<br />
budget preparations as well as reporting and accountability on
