Land law – Landlordtenant relationship – Tenant not served with notice of termination of tenancy-Whether order of certiorari can issue.A decision was made by an Assistant Registrar of Buildings to terminate thetency of the respondent. A prayer for the order of certiorari to issue was grantedby the High Court. The decisionD terminating the tenancy of the respondent was quashed and he was reinstatedas the lawful tenant of the premises. The Assistant Registrar of Buildingsappealed against this decision.Held: Certiorari being a discretionary remedy for the courts to issue,E It can not be issued in a case where there is already a contractual relationshipbetween landlord and tenant – relationship of commercial or business nature.Recourse to a court of law to adjudicate on breaches of contract would be abetter procedure.F Appeal allowed.508
