PROCEDURE FOR THE AMENDMENT OFREGIONAL SUPPLEMENTARY PROCEDURES(Approved by Council (25-2) 20/5/55, (84-5) 7/3/75, (153-3) 25/2/98)1. INTRODUCTION1.1 <strong>Regional</strong> Supplem<strong>en</strong>tary <strong>Procedures</strong> are normally formulated at regional air navigation meetings andbecome effective after review by the Air Navigation Commission and approval by the Council.1.2 Am<strong>en</strong>dm<strong>en</strong>ts to <strong>Regional</strong> Supplem<strong>en</strong>tary <strong>Procedures</strong> may be proposed by a Contracting State or group ofStates as set out in Section 2 or by an international organization as set out in Section 3 or may become necessary as a<strong>cons</strong>equ<strong>en</strong>ce of action by Council in adopting or am<strong>en</strong>ding Standards and Recomm<strong>en</strong>ded Practices or in approving oram<strong>en</strong>ding <strong>Procedures</strong> for Air Navigation Services as set out in Section 4.2. AMENDMENTS PROPOSED BYA CONTRACTING STATE OR GROUP OF STATES2.1 If any Contracting State or group of States of a region wishes to propose an am<strong>en</strong>dm<strong>en</strong>t to <strong>Regional</strong>Supplem<strong>en</strong>tary <strong>Procedures</strong> for that region, it should submit the proposal, adequately docum<strong>en</strong>ted, to the SecretaryG<strong>en</strong>eral through the <strong>Regional</strong> Office accredited to that State. The proposal should include the facts that led the State tothe conclusion that the am<strong>en</strong>dm<strong>en</strong>t is necessary.2.2 The Secretary G<strong>en</strong>eral will circulate the proposal, adequately docum<strong>en</strong>ted, with a request for comm<strong>en</strong>ts toall provider and user States of the region <strong>cons</strong>idered affected, as well as to user States outside the region andinternational organizations that may be concerned with the proposal. If, however, the Secretary G<strong>en</strong>eral <strong>cons</strong>iders thatthe proposed am<strong>en</strong>dm<strong>en</strong>t conflicts with established ICAO policy or that it raises questions which the Secretary G<strong>en</strong>eral<strong>cons</strong>iders should be brought to the att<strong>en</strong>tion of the Air Navigation Commission, the proposal will be first pres<strong>en</strong>ted,adequately docum<strong>en</strong>ted, to the Commission. In such cases, the Commission will decide on the action to be tak<strong>en</strong>.2.3 If, in reply to the Secretary G<strong>en</strong>eral’s inquiry to States and selected international organizations, noobjection is raised to the proposal by a specified date, the Secretary G<strong>en</strong>eral will circulate an am<strong>en</strong>dm<strong>en</strong>t memorandumto Repres<strong>en</strong>tatives on the Council and to Members of the Air Navigation Commission inviting each recipi<strong>en</strong>t to advise,normally within sev<strong>en</strong> days,* whether formal discussion of the proposed am<strong>en</strong>dm<strong>en</strong>t is desired. The memorandum willexplain the proposed am<strong>en</strong>dm<strong>en</strong>t, summarize the comm<strong>en</strong>ts received and include Secretariat comm<strong>en</strong>ts as appropriate.If, in reply to the Secretary G<strong>en</strong>eral’s inquiry to States and selected international organizations, any objection is raisedand if the objection remains after further <strong>cons</strong>ultation, the matter will be docum<strong>en</strong>ted for formal <strong>cons</strong>ideration by the AirNavigation Commission and appropriate recomm<strong>en</strong>dations of the Commission to the Council.2.4 If, at the <strong>en</strong>d of the sev<strong>en</strong>-day period,* there has be<strong>en</strong> no request for discussion of the am<strong>en</strong>dm<strong>en</strong>t, it willbe submitted to the Presid<strong>en</strong>t of the Council who is authorized to approve the am<strong>en</strong>dm<strong>en</strong>t on behalf of the Council.* During recess, a period of three weeks will normally be allowed.(vii) 30/11/07
