IV.B. Custodians <strong>of</strong> Education RecordsThe custodian <strong>of</strong> education records is1. For UMUC Adelphi: the registrar located inAdelphi, <strong>Maryland</strong>.2. For UMUC Asia: the registrar located inTokyo, Japan.3. For UMUC Europe: the registrar located inHeidelberg, Germany.4. For Mannheim: the registrar located inHeidelberg, Germany.5. For Schwäbisch Gmünd: the registrar located inAdelphi, <strong>Maryland</strong>.C. Procedure to Request Review and/or Inspection <strong>of</strong>Education RecordsRequests for review and/or inspection <strong>of</strong> educationrecords should be made in writing to the appropriatecustodian <strong>of</strong> records, as defined above. The custodian<strong>of</strong> records or designee will comply with a request foraccess within a reasonable time by arranging for thestudent to review his or her records in the presence<strong>of</strong> a staff member. If facilities permit, a student mayobtain copies <strong>of</strong> his or her records by paying reproductioncosts. The fee for copies is 50 cents per page.UMUC will not provide copies <strong>of</strong> any transcripts inthe student’s records other than the student’s currentUMUC transcript. Official transcripts (with the seal <strong>of</strong>UMUC) will be provided for a separate fee.AMENDMENT OF EDUCATION RECORDSStudents may request an amendment <strong>of</strong> their educationrecords in accordance with this procedure.A. Request to Amend Education RecordsA student who believes that his or her educationrecords are inaccurate, misleading, or in violation <strong>of</strong> thestudent’s rights <strong>of</strong> privacy may ask the custodian <strong>of</strong> theeducation records to amend the record. The custodian<strong>of</strong> the education records or designee will decidewhether to amend the record within a reasonable timeafter the request. If the custodian <strong>of</strong> the educationrecords or designee decides not to amend the record, heor she will inform the student <strong>of</strong> the right to a hearing.B. Hearings1. A student may submit a written request for ahearing to challenge the content <strong>of</strong> his or hereducation records to the university registrar. Thewritten request must state what records the studentbelieves are inaccurate, misleading, or in violation<strong>of</strong> the privacy rights <strong>of</strong> the student.2. A hearing will be conducted by the universityregistrar or designee. The hearing may take placevia telephone or video conferencing. The studentwill be given an opportunity to present evidencerelevant to the issues raised and may be assisted orrepresented by individuals <strong>of</strong> his or her choice athis or her own expense, including an attorney.3. Within a reasonable period <strong>of</strong> time after theconclusion <strong>of</strong> a hearing, the university registrar willnotify the student in writing <strong>of</strong> his decision. Thewritten decision will include a summary <strong>of</strong> theevidence and the reasons for the decision.V. DISCLOSURESa. If the university registrar determines that theeducation record is inaccurate, misleading,or in violation <strong>of</strong> the privacy <strong>of</strong> the student,the education records will be amended. Theuniversity registrar will inform the student <strong>of</strong>the amendment in writing.b. If, as a result <strong>of</strong> the hearing, the universityregistrar decides that the education record isnot inaccurate, misleading, or otherwise inviolation <strong>of</strong> the privacy rights <strong>of</strong> the student,he will inform the student <strong>of</strong> the right to placea statement in the record commenting on thecontested information in the record or statingwhy he or she disagrees with the decision <strong>of</strong>the agency or institution, or both. Any suchexplanation will be kept as part <strong>of</strong> the student’srecord as long as the contested portion <strong>of</strong> therecord is kept and will be disclosed wheneverthe contested portion <strong>of</strong> the record is disclosed.UMUC will not disclose education records or the personallyidentifiable information contained therein unless permittedby FERPA and under the following circumstances:A. Prior Written ConsentThe custodian <strong>of</strong> the records will provide the educationrecords or personally identifiable informationcontained therein if the student provides prior writtenconsent that the information may be disclosed. Theconsent must1. Specify the records that may be disclosed;2. State the purpose for the disclosure;3. Identify to whom the disclosure is to be made; and4. Be signed and dated by the student.At the student’s request and expense, a copy <strong>of</strong> therecords disclosed will be provided to the student.w w w.umuc.edu / grad 181
