Any person who produces, obtains, possesses, supplies or deals with materials, devices, equipment or computerprograms to be used to forge non-cash payment instruments is guilty <strong>of</strong> a misdemeanor and shall be punished by up toone year’s imprisonment, community service or a fine.For the purposes <strong>of</strong> Sections 313/B-313/D, ‘non-cash payment instrument’ shall mean the non-cash paymentinstruments defined in specific other legislation, traveler’s checks and bills <strong>of</strong> exchange, provided they containprotective measures against duplication, forgery and unauthorized use. Non-cash payment instruments issued in othercountries shall receive the same protection as those issued in the domestic territory.(1) Any person who violates the financial interest <strong>of</strong> the European Communities in connection withassistance provided from funds managed by or on behalf <strong>of</strong> the European Communities,payments made to funds managed by or on behalf <strong>of</strong> the European Communities,by making a false affidavit to this extent, or by using a false, counterfeit or forged document or instrument, or wh<strong>of</strong>ails to comply with the prescribed obligation to provide information or the information provided is insufficient ormisleading, is guilty <strong>of</strong> felony punishable by imprisonment not to exceed five years.(2) The punishment defined in Subsection (1) shall apply if the perpetrator usesthe assistance referred to in Paragraph <strong>of</strong> Subsection (1), orthe payment allowance referred to in Paragraph <strong>of</strong> Subsection (1)for purposes other than authorized.(3) The director <strong>of</strong> a business association, or a member or employee with authority to exercise control or supervisionshall be punished according to Subsection (1), if the member or employee <strong>of</strong> the business association commits thecriminal act defined in Subsections (1) and (2) for the benefit <strong>of</strong> the business association, and the criminal act couldhave been prevented had he properly fulfilled his control or supervisory obligations.(4) The director <strong>of</strong> a business association, or a member or employee with authority to exercise control or supervisionshall be punished for misdemeanor by imprisonment not to exceed two years, work in community service or a fine, ifthe criminal act defined in Subsection (3) is committed involuntarily.(1) For the purposes <strong>of</strong> this Chapter, goods shall also mean industrial services or other services <strong>of</strong> economic nature,and price shall also mean any compensation <strong>of</strong> pecuniary value due for the goods (services).(2)
