(1) Any public <str<strong>on</strong>g>of</str<strong>on</strong>g>ficial who requests an unlawful advantage in c<strong>on</strong>necti<strong>on</strong> with his acti<strong>on</strong>s in an <str<strong>on</strong>g>of</str<strong>on</strong>g>ficial capacity, oraccepts such advantage or a promise <strong>the</strong>re<str<strong>on</strong>g>of</str<strong>on</strong>g>, or agrees with <strong>the</strong> party requesting or accepting <strong>the</strong> advantage, is guilty <str<strong>on</strong>g>of</str<strong>on</strong>g>a fel<strong>on</strong>y punishable by impris<strong>on</strong>ment between <strong>on</strong>e to five years.(2) The punishment shall be impris<strong>on</strong>ment between two to eight years if <strong>the</strong> crime is committedby a public <str<strong>on</strong>g>of</str<strong>on</strong>g>ficial in a high <str<strong>on</strong>g>of</str<strong>on</strong>g>fice, or by <strong>on</strong>e entrusted to take measures in important affairs,by ano<strong>the</strong>r public <str<strong>on</strong>g>of</str<strong>on</strong>g>ficial in an important matter <str<strong>on</strong>g>of</str<strong>on</strong>g> great importance.(3) The perpetrator shall be punished by impris<strong>on</strong>ment between two to eight years, or between five to ten years inaccordance with <strong>the</strong> distincti<strong>on</strong> c<strong>on</strong>tained in Subsecti<strong>on</strong>s (1) and (2), if he breaches his <str<strong>on</strong>g>of</str<strong>on</strong>g>ficial duty in exchange forunlawful advantage, exceeds his competence or o<strong>the</strong>rwise abuses his <str<strong>on</strong>g>of</str<strong>on</strong>g>ficial positi<strong>on</strong>, or if he commits <strong>the</strong> act incriminal c<strong>on</strong>spiracy or in a pattern <str<strong>on</strong>g>of</str<strong>on</strong>g> criminal pr<str<strong>on</strong>g>of</str<strong>on</strong>g>iteering.(1) Any employee or member <str<strong>on</strong>g>of</str<strong>on</strong>g> a budgetary agency, ec<strong>on</strong>omic organizati<strong>on</strong> or n<strong>on</strong>-governmental organizati<strong>on</strong> whorequests an unlawful advantage in c<strong>on</strong>necti<strong>on</strong> with his acti<strong>on</strong>s in an <str<strong>on</strong>g>of</str<strong>on</strong>g>ficial capacity, accepts such advantage or apromise in exchange for violating his resp<strong>on</strong>sibilities or agrees with <strong>the</strong> party requesting or accepting <strong>the</strong> advantage isguilty <str<strong>on</strong>g>of</str<strong>on</strong>g> a misdemeanor punishable by up to two years’ impris<strong>on</strong>ment.(2) Any pers<strong>on</strong> who breaches his <str<strong>on</strong>g>of</str<strong>on</strong>g>ficial duty in exchange for unlawful advantage is guilty <str<strong>on</strong>g>of</str<strong>on</strong>g> fel<strong>on</strong>y punishable byimpris<strong>on</strong>ment between <strong>on</strong>e to five years, or between two to eight years if <strong>the</strong> breach involves a matter <str<strong>on</strong>g>of</str<strong>on</strong>g> greaterimportance or if committed in criminal c<strong>on</strong>spiracy or in a pattern <str<strong>on</strong>g>of</str<strong>on</strong>g> criminal pr<str<strong>on</strong>g>of</str<strong>on</strong>g>iteering.(1) Any employee or member who is authorized to act in <strong>the</strong> name and <strong>on</strong> behalf <str<strong>on</strong>g>of</str<strong>on</strong>g> a budgetary agency, ec<strong>on</strong>omicorganizati<strong>on</strong> or n<strong>on</strong>-governmental organizati<strong>on</strong>, who requests an unlawful advantage in c<strong>on</strong>necti<strong>on</strong> with his acti<strong>on</strong>s inan <str<strong>on</strong>g>of</str<strong>on</strong>g>ficial capacity, or accepts such advantage or a promise <strong>the</strong>re<str<strong>on</strong>g>of</str<strong>on</strong>g>, or agrees with <strong>the</strong> party requesting or accepting <strong>the</strong>advantage, is guilty <str<strong>on</strong>g>of</str<strong>on</strong>g> a fel<strong>on</strong>y punishable by impris<strong>on</strong>ment between <strong>on</strong>e to five years.(2) Any pers<strong>on</strong> who breaches his <str<strong>on</strong>g>of</str<strong>on</strong>g>ficial duty in exchange for unlawful advantage may be punished by impris<strong>on</strong>mentbetween two to eight years.(3) The punishment shall be impris<strong>on</strong>ment between five to ten yearsif <strong>the</strong> breach involves a matter <str<strong>on</strong>g>of</str<strong>on</strong>g> greater importance,if committed in criminal c<strong>on</strong>spiracy or in a pattern <str<strong>on</strong>g>of</str<strong>on</strong>g> criminal pr<str<strong>on</strong>g>of</str<strong>on</strong>g>iteering.(1) Any pers<strong>on</strong> who gives or promises unlawful advantage to a public <str<strong>on</strong>g>of</str<strong>on</strong>g>ficial or to ano<strong>the</strong>r pers<strong>on</strong> <strong>on</strong> account <str<strong>on</strong>g>of</str<strong>on</strong>g> such<str<strong>on</strong>g>of</str<strong>on</strong>g>ficial’s acti<strong>on</strong>s in an <str<strong>on</strong>g>of</str<strong>on</strong>g>ficial capacity is guilty <str<strong>on</strong>g>of</str<strong>on</strong>g> a fel<strong>on</strong>y punishable by impris<strong>on</strong>ment not to exceed three years.(2) The pers<strong>on</strong> committing bribery shall be punished for a fel<strong>on</strong>y by impris<strong>on</strong>ment between <strong>on</strong>e to five years, if hegives or promises <strong>the</strong> advantage to a public <str<strong>on</strong>g>of</str<strong>on</strong>g>ficial to induce him to breach his <str<strong>on</strong>g>of</str<strong>on</strong>g>ficial duty, exceed his competence oro<strong>the</strong>rwise abuse his <str<strong>on</strong>g>of</str<strong>on</strong>g>ficial positi<strong>on</strong>.(3) The director <str<strong>on</strong>g>of</str<strong>on</strong>g> a business associati<strong>on</strong>, or a member or employee with authority to exercise c<strong>on</strong>trol or supervisi<strong>on</strong>shall be punished according to Subsecti<strong>on</strong> (1), if <strong>the</strong> member or employee <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> business associati<strong>on</strong> commits <strong>the</strong>criminal act defined in Subsecti<strong>on</strong>s (1) and (2) for <strong>the</strong> benefit <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> business associati<strong>on</strong>, and <strong>the</strong> criminal act couldhave been prevented had he properly fulfilled his c<strong>on</strong>trol or supervisory obligati<strong>on</strong>s.
