(1) Any person who commits an act <strong>of</strong> assault against a person under international protection while in the domesticterritory, deprives such person <strong>of</strong> his personal freedom, endangers his privacy or violates his personal freedom by, inparticular, an assault on his <strong>of</strong>fice, private residence or means <strong>of</strong> transport is guilty <strong>of</strong> a felony and shall be punished byup to five years’ imprisonment.(2) Any person threatening to commit the crime specified in Subsection (1) is guilty <strong>of</strong> a felony and shall be punishedby up to three years’ imprisonment.(3) For the purposes <strong>of</strong> this <strong>Act</strong>, a ‘person under international protection’ shall mean any foreign <strong>of</strong>ficial granteddiplomatic immunity by virtue <strong>of</strong> a treaty or some other form <strong>of</strong> privilege under international law.(1) The person wh<strong>of</strong>alsely accuses another person before an authority with the perpetration <strong>of</strong> a crime,makes known a forged evidence relating to a crime to the authoritycommits a felony, and shall be punishable with imprisonment <strong>of</strong> up to three years.(2) The punishment shall be imprisonment <strong>of</strong> up to five years, if criminal proceedings are instituted on the basis <strong>of</strong>the malicious prosecution.(3) If the accused is sentenced on the basis <strong>of</strong> the malicious prosecution, the punishment shall be imprisonment fromtwo years to eight years.The person who falsely accuses another person before an authority with the perpetration <strong>of</strong> a crime, because he doesnot know by negligence, that his statement <strong>of</strong> fact is untrue, or the evidence is false, commits a misdemeanour, and shallbe punishable with imprisonment <strong>of</strong> up to one year, labour in the public interest, or fine.The person wh<strong>of</strong>alsely accuses another person with the perpetration <strong>of</strong> a minor <strong>of</strong>fence before an investigating authority, theprosecutor, the court or an authority dealing with minor <strong>of</strong>fences, or with the perpetration <strong>of</strong> a disciplinarymisdemeanour before an investigating authority, prosecutor, court or the party exercising disciplinary authority,makes known a forged evidence against another person to the authority designated in paragraph , relating to aminor <strong>of</strong>fence or a disciplinary misdemeanour,commits a misdemeanour, and shall be punishable with imprisonment <strong>of</strong> up to one year, labour in the public interest,or fine.
