(1) Any pers<strong>on</strong> who commits an act <str<strong>on</strong>g>of</str<strong>on</strong>g> assault against a pers<strong>on</strong> under internati<strong>on</strong>al protecti<strong>on</strong> while in <strong>the</strong> domesticterritory, deprives such pers<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> his pers<strong>on</strong>al freedom, endangers his privacy or violates his pers<strong>on</strong>al freedom by, inparticular, an assault <strong>on</strong> his <str<strong>on</strong>g>of</str<strong>on</strong>g>fice, private residence or means <str<strong>on</strong>g>of</str<strong>on</strong>g> transport is guilty <str<strong>on</strong>g>of</str<strong>on</strong>g> a fel<strong>on</strong>y and shall be punished byup to five years’ impris<strong>on</strong>ment.(2) Any pers<strong>on</strong> threatening to commit <strong>the</strong> crime specified in Subsecti<strong>on</strong> (1) is guilty <str<strong>on</strong>g>of</str<strong>on</strong>g> a fel<strong>on</strong>y and shall be punishedby up to three years’ impris<strong>on</strong>ment.(3) For <strong>the</strong> purposes <str<strong>on</strong>g>of</str<strong>on</strong>g> this <str<strong>on</strong>g>Act</str<strong>on</strong>g>, a ‘pers<strong>on</strong> under internati<strong>on</strong>al protecti<strong>on</strong>’ shall mean any foreign <str<strong>on</strong>g>of</str<strong>on</strong>g>ficial granteddiplomatic immunity by virtue <str<strong>on</strong>g>of</str<strong>on</strong>g> a treaty or some o<strong>the</strong>r form <str<strong>on</strong>g>of</str<strong>on</strong>g> privilege under internati<strong>on</strong>al law.(1) The pers<strong>on</strong> wh<str<strong>on</strong>g>of</str<strong>on</strong>g>alsely accuses ano<strong>the</strong>r pers<strong>on</strong> before an authority with <strong>the</strong> perpetrati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> a crime,makes known a forged evidence relating to a crime to <strong>the</strong> authoritycommits a fel<strong>on</strong>y, and shall be punishable with impris<strong>on</strong>ment <str<strong>on</strong>g>of</str<strong>on</strong>g> up to three years.(2) The punishment shall be impris<strong>on</strong>ment <str<strong>on</strong>g>of</str<strong>on</strong>g> up to five years, if criminal proceedings are instituted <strong>on</strong> <strong>the</strong> basis <str<strong>on</strong>g>of</str<strong>on</strong>g><strong>the</strong> malicious prosecuti<strong>on</strong>.(3) If <strong>the</strong> accused is sentenced <strong>on</strong> <strong>the</strong> basis <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> malicious prosecuti<strong>on</strong>, <strong>the</strong> punishment shall be impris<strong>on</strong>ment fromtwo years to eight years.The pers<strong>on</strong> who falsely accuses ano<strong>the</strong>r pers<strong>on</strong> before an authority with <strong>the</strong> perpetrati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> a crime, because he doesnot know by negligence, that his statement <str<strong>on</strong>g>of</str<strong>on</strong>g> fact is untrue, or <strong>the</strong> evidence is false, commits a misdemeanour, and shallbe punishable with impris<strong>on</strong>ment <str<strong>on</strong>g>of</str<strong>on</strong>g> up to <strong>on</strong>e year, labour in <strong>the</strong> public interest, or fine.The pers<strong>on</strong> wh<str<strong>on</strong>g>of</str<strong>on</strong>g>alsely accuses ano<strong>the</strong>r pers<strong>on</strong> with <strong>the</strong> perpetrati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> a minor <str<strong>on</strong>g>of</str<strong>on</strong>g>fence before an investigating authority, <strong>the</strong>prosecutor, <strong>the</strong> court or an authority dealing with minor <str<strong>on</strong>g>of</str<strong>on</strong>g>fences, or with <strong>the</strong> perpetrati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> a disciplinarymisdemeanour before an investigating authority, prosecutor, court or <strong>the</strong> party exercising disciplinary authority,makes known a forged evidence against ano<strong>the</strong>r pers<strong>on</strong> to <strong>the</strong> authority designated in paragraph , relating to aminor <str<strong>on</strong>g>of</str<strong>on</strong>g>fence or a disciplinary misdemeanour,commits a misdemeanour, and shall be punishable with impris<strong>on</strong>ment <str<strong>on</strong>g>of</str<strong>on</strong>g> up to <strong>on</strong>e year, labour in <strong>the</strong> public interest,or fine.
