(3) The pers<strong>on</strong> who deserts abroad, shall be punishable with impris<strong>on</strong>ment from five years to fifteen years.(4) The pers<strong>on</strong> who deserts abroad in <strong>the</strong> manner defined in subsecti<strong>on</strong> (2), paragraphs to , or commits deserti<strong>on</strong>in war-time, shall be punishable with impris<strong>on</strong>ment from ten years to fifteen years or with life impris<strong>on</strong>ment.(5) The pers<strong>on</strong> who commits preparati<strong>on</strong> for deserti<strong>on</strong> as defined in subsecti<strong>on</strong> (2) or subsecti<strong>on</strong> (3), shall bepunishable for a fel<strong>on</strong>y with impris<strong>on</strong>ment from <strong>on</strong>e year to five years, in war-time from five years to ten years.(6)(7) The punishment <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> perpetrator <str<strong>on</strong>g>of</str<strong>on</strong>g> deserti<strong>on</strong> may be mitigated without limitati<strong>on</strong>, if he voluntarily presentshimself to <strong>the</strong> authorities.The pers<strong>on</strong> who credibly learns that perpetrati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> deserti<strong>on</strong> abroad is prepared or such a crime not yet detected hasbeen committed, and fails to report that as so<strong>on</strong> as he can, commits a fel<strong>on</strong>y and shall be punishable with impris<strong>on</strong>ment<str<strong>on</strong>g>of</str<strong>on</strong>g> up to three years. The relative <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> perpetrator shall not be punishable for omitting <strong>the</strong> reporting.(1) The pers<strong>on</strong> who arbitrarily leaves his service post or remains absent <strong>the</strong>refrom, and his absence exceeds fortyeighthours, commits a misdemeanour, and shall be punishable with impris<strong>on</strong>ment <str<strong>on</strong>g>of</str<strong>on</strong>g> up to <strong>on</strong>e year, in war-time for afel<strong>on</strong>y with impris<strong>on</strong>ment from <strong>on</strong>e year to five years.(2) If <strong>the</strong> durati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> arbitrary absence exceeds nine days, <strong>the</strong> punishment shall be for a fel<strong>on</strong>y impris<strong>on</strong>ment <str<strong>on</strong>g>of</str<strong>on</strong>g> up tothree years, in war-time impris<strong>on</strong>ment from two years to eight years.(1) The pers<strong>on</strong> who - with <strong>the</strong> aim <str<strong>on</strong>g>of</str<strong>on</strong>g> withdrawing himself from <strong>the</strong> performance <str<strong>on</strong>g>of</str<strong>on</strong>g> his military service - mutilateshis body, injures his health or displays a misleading c<strong>on</strong>duct, shall be punishable with impris<strong>on</strong>ment from <strong>on</strong>e year t<str<strong>on</strong>g>of</str<strong>on</strong>g>ive years, in war-time with impris<strong>on</strong>ment from ten years to fifteen years or with life impris<strong>on</strong>ment.(2) The pers<strong>on</strong> who commits <strong>the</strong> crime defined in subsecti<strong>on</strong> (1) for temporarily withdrawing himself from <strong>the</strong>performance <str<strong>on</strong>g>of</str<strong>on</strong>g> his military service, shall be punishable for misdemeanour with impris<strong>on</strong>ment <str<strong>on</strong>g>of</str<strong>on</strong>g> up to <strong>on</strong>e year, in wartimefor a fel<strong>on</strong>y with impris<strong>on</strong>ment from <strong>on</strong>e year to five years.(3) If <strong>the</strong> durati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> temporary withdrawal exceeds six days, <strong>the</strong> punishment shall be for a fel<strong>on</strong>y impris<strong>on</strong>ment <str<strong>on</strong>g>of</str<strong>on</strong>g>up to three years, in war-time impris<strong>on</strong>ment from two years to eight years.The pers<strong>on</strong> who refuses to perform his military service, commits a fel<strong>on</strong>y and shall be punishable with impris<strong>on</strong>mentfrom <strong>on</strong>e year to five years, in war-time with impris<strong>on</strong>ment from ten years to fifteen years, or life impris<strong>on</strong>ment.
