imprisonment from two years to eight years, if the violation <strong>of</strong> state secret is committed in respect <strong>of</strong> an especiallyimportant state secret or causing a great disadvantageimprisonment from five years to fifteen years, if the state secret becomes available to an incompetent foreignperson.(3) The person who commits the violation <strong>of</strong> state secret by negligence shall be punishable for a misdemeanour withimprisonment <strong>of</strong> up to one year, in the cases <strong>of</strong> subsection (2) with imprisonment <strong>of</strong> up to two years or up to five years,in accordance with the distinction written there.(4) The person, who perpetrates preparation for the violation <strong>of</strong> state secret defined in subsection (2), shall bepunishable for a felony with imprisonment up to three years, or up to five years, in accordance with the distinctionwritten there.(1) The person whoobtains without authorization a service secret,uses without authorization or makes available for an incompetent person a service secret that came to hisknowledge or into his possessioncommits a misdemeanour, and shall be punishable with imprisonment <strong>of</strong> up to one year, labour in the public interest,or fine.(2) The punishment shall be imprisonment <strong>of</strong> up to three years for a felony, if the crime causes a grave disadvantage.(3) The punishment shall beimprisonment from one year to five years, if - as a consequence <strong>of</strong> the crime - a service secret,imprisonment from two years to eight years, if - in consequence <strong>of</strong> the crime - a military service secretbecomes available to an incompetent foreign person.(1) The person who credibly learns thatthe perpetration <strong>of</strong> violation <strong>of</strong> a state secret is prepared,an intentional violation <strong>of</strong> state secret not yet detected has been committed,and fails to report it to the authorities as soon as he can, commits a misdemeanour, and shall be punishable withimprisonment <strong>of</strong> up to one year, with labour in the public interest, or fine.(2) On the basis <strong>of</strong> subsection (1), relatives <strong>of</strong> the perpetrator shall not be punishable.
