A military commander who, violating <strong>the</strong> rules <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> internati<strong>on</strong>al law <str<strong>on</strong>g>of</str<strong>on</strong>g> warfarepursues war operati<strong>on</strong> which causes serious damage in <strong>the</strong> life, health or goods <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> civilian populati<strong>on</strong>, ininternati<strong>on</strong>ally protected cultural goods, in facilities c<strong>on</strong>taining dangerous forces,takes <str<strong>on</strong>g>of</str<strong>on</strong>g>fensive against a locality without defence or a weap<strong>on</strong>-free z<strong>on</strong>e,commits a fel<strong>on</strong>y and shall be punishable with impris<strong>on</strong>ment from ten years to fifteen years, or life impris<strong>on</strong>ment.(1) Any pers<strong>on</strong> who uses or orders <strong>the</strong> use <str<strong>on</strong>g>of</str<strong>on</strong>g> a weap<strong>on</strong> or instrument <str<strong>on</strong>g>of</str<strong>on</strong>g> war prohibited by internati<strong>on</strong>al treaty in a<strong>the</strong>ater <str<strong>on</strong>g>of</str<strong>on</strong>g> military operati<strong>on</strong> or in an occupied territory against <strong>the</strong> enemy, civilians or pris<strong>on</strong>ers <str<strong>on</strong>g>of</str<strong>on</strong>g> war commits afel<strong>on</strong>y <str<strong>on</strong>g>of</str<strong>on</strong>g>fense and shall be punishable with impris<strong>on</strong>ment between ten to fifteen years or life impris<strong>on</strong>ment.(2) Any pers<strong>on</strong> who makes preparati<strong>on</strong>s for <strong>the</strong> use <str<strong>on</strong>g>of</str<strong>on</strong>g> a weap<strong>on</strong> prohibited by internati<strong>on</strong>al treaty commits a fel<strong>on</strong>y<str<strong>on</strong>g>of</str<strong>on</strong>g>fense and shall be punishable with impris<strong>on</strong>ment <str<strong>on</strong>g>of</str<strong>on</strong>g> up to five years.(3) For <strong>the</strong> purposes <str<strong>on</strong>g>of</str<strong>on</strong>g> Subsecti<strong>on</strong>s (1)-(2) <strong>the</strong> following shall be c<strong>on</strong>strued as weap<strong>on</strong>s prohibited by internati<strong>on</strong>altreaty:asphyxiating, pois<strong>on</strong>ous and o<strong>the</strong>r gases and bacteriological methods <str<strong>on</strong>g>of</str<strong>on</strong>g> warfare as set forth in <strong>the</strong> protocol signedat Geneva <strong>on</strong> 17 June 1925 <strong>on</strong> <strong>the</strong> Prohibiti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> Use in War <str<strong>on</strong>g>of</str<strong>on</strong>g> Asphyxiating, Pois<strong>on</strong>ous or O<strong>the</strong>r Gases, and <str<strong>on</strong>g>of</str<strong>on</strong>g>Bacteriological Methods <str<strong>on</strong>g>of</str<strong>on</strong>g> Warfare, as promulgated by Law-Decree 20 <str<strong>on</strong>g>of</str<strong>on</strong>g> 1955,<strong>the</strong> following weap<strong>on</strong>s listed in <strong>the</strong> protocols to <strong>the</strong> c<strong>on</strong>venti<strong>on</strong> signed at Geneva <strong>on</strong> 15 October 1985 <strong>on</strong>Prohibiti<strong>on</strong>s or Restricti<strong>on</strong>s <strong>on</strong> <strong>the</strong> Use <str<strong>on</strong>g>of</str<strong>on</strong>g> Certain C<strong>on</strong>venti<strong>on</strong>al Weap<strong>on</strong>s which may be Deemed to be ExcessivelyInjurious or to have Indiscriminate Effects, as promulgated by Law-Decree 2 <str<strong>on</strong>g>of</str<strong>on</strong>g> 1984:1. weap<strong>on</strong>s causing injury by fragments which cannot be detected by X-ray, as specified in Protocol I,2. mines, remotely-delivered mines, anti-pers<strong>on</strong>nel mines, booby-traps and o<strong>the</strong>r devices specified in Points 1-5 <str<strong>on</strong>g>of</str<strong>on</strong>g>Article 2 <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> Amended Protocol II, as promulgated by <str<strong>on</strong>g>Act</str<strong>on</strong>g> CXXXIII <str<strong>on</strong>g>of</str<strong>on</strong>g> 1997,3. incendiary weap<strong>on</strong>s specified in Point 1 <str<strong>on</strong>g>of</str<strong>on</strong>g> Article 1 <str<strong>on</strong>g>of</str<strong>on</strong>g> Protocol III,4. blinding laser weap<strong>on</strong>s specified in Article 1 <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> Supplementary Protocol <str<strong>on</strong>g>IV</str<strong>on</strong>g>,chemical weap<strong>on</strong>s and chemical instruments <str<strong>on</strong>g>of</str<strong>on</strong>g> war specified in Points 1 and 7 <str<strong>on</strong>g>of</str<strong>on</strong>g> Article 2 <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> c<strong>on</strong>venti<strong>on</strong>signed at Paris <strong>on</strong> 13 January 1993 <strong>on</strong> C<strong>on</strong>venti<strong>on</strong> <strong>on</strong> <strong>the</strong> Prohibiti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> Development, Producti<strong>on</strong>, Stockpiling andUse <str<strong>on</strong>g>of</str<strong>on</strong>g> Chemical Weap<strong>on</strong>s and <strong>on</strong> <strong>the</strong>ir Destructi<strong>on</strong>, as promulgated by <str<strong>on</strong>g>Act</str<strong>on</strong>g> C<str<strong>on</strong>g>IV</str<strong>on</strong>g> <str<strong>on</strong>g>of</str<strong>on</strong>g> 1997,anti-pers<strong>on</strong>nel mines specified in Point 1 <str<strong>on</strong>g>of</str<strong>on</strong>g> Article 2 <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> c<strong>on</strong>venti<strong>on</strong> signed at Oslo <strong>on</strong> 18 September 1997 <strong>on</strong><strong>the</strong> Prohibiti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> Use, Stockpiling, Producti<strong>on</strong> and Transfer <str<strong>on</strong>g>of</str<strong>on</strong>g> Anti-Pers<strong>on</strong>nel Mines and <strong>on</strong> <strong>the</strong>ir Destructi<strong>on</strong>, aspromulgated by <str<strong>on</strong>g>Act</str<strong>on</strong>g> X <str<strong>on</strong>g>of</str<strong>on</strong>g> 1998.The pers<strong>on</strong> who loots <strong>the</strong> fallen, injured or sick people <strong>on</strong> <strong>the</strong> battlefield, commits a fel<strong>on</strong>y and shall be punishablewith impris<strong>on</strong>ment from two years to eight years.
