(1) The person who unlawfully appropriates or disposes <strong>of</strong> as its own over an alien thing entrusted to him, commitsembezzlement.(2) The punishment shall be for a misdemeanour imprisonment <strong>of</strong> up to two years, labour in the public interest, orfine, if the embezzlement is committed in respect <strong>of</strong> a smaller value, or the embezzlement committed in respect <strong>of</strong> thevalue <strong>of</strong> minor <strong>of</strong>fence is committedas part <strong>of</strong> a criminal conspiracy,at the scene <strong>of</strong> public danger,in a business-like manner.(3)(4) The punishment shall be for a felony imprisonment <strong>of</strong> up to three years, ifthe embezzlement is committed for a greater value,the embezzlement committed in respect <strong>of</strong> a smaller value is committed in the manner defined in subsection (2),paragraphs tothe embezzlement is committed in respect <strong>of</strong> an object qualified as part <strong>of</strong> cultural heritage.(5) The punishment shall be imprisonment from one year to five years, ifthe embezzlement is committed for a considerable value,the embezzlement committed for a larger value is committed in the manner defined in subsection (2), paragraphsto .(6) The punishment shall be imprisonment from two years to eight years, ifthe embezzlement is committed for an especially high value,the embezzlement committed for a considerable value is committed in the manner defined in subsection (2),paragraphs to .(7) The punishment shall be imprisonment between five to ten years for the crime <strong>of</strong> embezzlement if committedin respect <strong>of</strong> particularly substantial value,in respect <strong>of</strong> particularly considerable amount in the manner described in Paragraphs a)-c) <strong>of</strong> Subsection (2) above.(1) The person who - for unlawful pr<strong>of</strong>it-making - leads somebody into error or keeps in error and causes damagethereby, commits fraud.(2) The punishment shall be for a misdemeanour imprisonment <strong>of</strong> up to two years, labour in the public interest, orfine, if the fraud causes a smaller damage, or the fraud not exceeding the value limit for minor <strong>of</strong>fence is committedas part <strong>of</strong> a criminal conspiracy,on the scene <strong>of</strong> public danger,in a business-like manner.(3)(4) The punishment shall be for a felony imprisonment <strong>of</strong> up to three years, ifthe fraud causes a greater damage,the fraud causing a smaller damage is committed in the manner defined in subsection (2), paragraphs to .(5) The punishment shall be imprisonment from one year to five years, ifthe fraud causes considerable damage,the fraud causing greater damage is committed in the manner defined in subsection (2), paragraphs to .(6) The punishment shall be imprisonment from two years to eight years, ifthe fraud causes an especially great damage,the fraud causing a considerable damage is committed in the manner defined in subsection (2), paragraphs to(7) The punishment shall be imprisonment between five to ten years for the crime <strong>of</strong> fraud if committedcausing particularly substantial damage,
