(1) The person who kills another person, commits a felony, and shall be punishable with imprisonment from fiveyears to fifteen years.(2) The punishment shall be imprisonment from ten years to fifteen years, or life imprisonment, if the homicide iscommittedplanned in advance,for pr<strong>of</strong>it-makingfor another base reason or purpose,with special cruelty,against a public <strong>of</strong>ficial or a foreign public <strong>of</strong>ficial during or because <strong>of</strong> his <strong>of</strong>ficial proceedings, against a personperforming public duties during the performance <strong>of</strong> such duties, or against a person providing assistance to or acting indefense <strong>of</strong> such persons performing <strong>of</strong>ficial or public duties,on more than one person,endangering the life <strong>of</strong> many people,as special recidivist.against a person under the age <strong>of</strong> fourteen.(3) Any preparation to commit homicide shall be construed a felony and punishable by imprisonment <strong>of</strong> up to fiveyears.(4) A person, who commits negligent homicide (manslaughter), shall be punishable with imprisonment between oneto five years.(5) From the aspect <strong>of</strong> special recidivism, crimes <strong>of</strong> similar character areculpable voluntary manslaughter (Section 167), genocide [Paragraph a) <strong>of</strong> Subsection (1) <strong>of</strong> Section 155];cases <strong>of</strong> kidnapping and violence against a superior or a service <strong>of</strong>ficial qualifying as graver cases [Section 175/A,subsection (4), Section 355, subsection (5), paragraph ];cases <strong>of</strong> acts <strong>of</strong> terrorism, seizure <strong>of</strong> aircraft, any means <strong>of</strong> railway, water or road transport or any means <strong>of</strong> freighttransport and riot, if committed while also causing death intentionally [Section 261, subsection (2), paragraph ,Section 262, subsection (2), Section 352, subsection (3), paragraph ].The person who kills another person with diminished responsibility originating from an appreciable emotionalreason, commits a felony and shall be punishable with imprisonment from two years to eight years.The person who persuades somebody else to commit suicide, or <strong>of</strong>fers aid to the perpetration there<strong>of</strong>, commits afelony and shall be punishable with imprisonment <strong>of</strong> up to five years, if the suicide is attempted or perpetrated.(1) The person who effects an abortion on another person, commits a felony, and shall be punishable withimprisonment <strong>of</strong> up to three years.
