(1) Supplementary punishments may not be summed up, and similarly, an impris<strong>on</strong>ment substituting a fine may notbe summed up ei<strong>the</strong>r.(2) From am<strong>on</strong>g <strong>the</strong> supplementary punishments <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> same durati<strong>on</strong> - with <strong>the</strong> excepti<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> fine as supplementarypunishment - that <strong>on</strong>e shall be executed which is more disadvantageous for <strong>the</strong> c<strong>on</strong>vict. This shall also governsupplementary punishments applied in lieu <str<strong>on</strong>g>of</str<strong>on</strong>g> a principal punishment.(1) In respect <str<strong>on</strong>g>of</str<strong>on</strong>g> special and multiple recidivists - unless <strong>the</strong> law o<strong>the</strong>rwise provides - <strong>the</strong> upper limit <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> item <str<strong>on</strong>g>of</str<strong>on</strong>g>punishment <str<strong>on</strong>g>of</str<strong>on</strong>g> a new act <str<strong>on</strong>g>of</str<strong>on</strong>g> crime shall increase by half in case <str<strong>on</strong>g>of</str<strong>on</strong>g> impris<strong>on</strong>ment, but it may not exceed fifteen years. Inrespect <str<strong>on</strong>g>of</str<strong>on</strong>g> cumulative sentences and in respect <str<strong>on</strong>g>of</str<strong>on</strong>g> waiver <str<strong>on</strong>g>of</str<strong>on</strong>g> right to trial, <strong>the</strong> term <str<strong>on</strong>g>of</str<strong>on</strong>g> punishment set forth in Subsecti<strong>on</strong>(2) <str<strong>on</strong>g>of</str<strong>on</strong>g> Secti<strong>on</strong> 85 and in Secti<strong>on</strong> 87/C, respectively, shall be increased by <strong>on</strong>e-half.(2) The punishment may be mitigated <strong>on</strong> <strong>the</strong> basis <str<strong>on</strong>g>of</str<strong>on</strong>g> Secti<strong>on</strong> 87, subsecti<strong>on</strong> (2) <strong>on</strong>ly in a case deserving specialappreciati<strong>on</strong>.(3) The more severe legal c<strong>on</strong>sequences set forth in Subsecti<strong>on</strong> (1) shall not be applied if <strong>the</strong> Special Divisi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> this<str<strong>on</strong>g>Act</str<strong>on</strong>g> prescribes sentencing for qualified recidivists to c<strong>on</strong>sider such as an aggravating circumstance.(1) Any pers<strong>on</strong> who has knowingly committed a criminal act in affiliati<strong>on</strong> with organized crime (Point 8 <str<strong>on</strong>g>of</str<strong>on</strong>g> Secti<strong>on</strong>137) shall be subject to double <strong>the</strong> punishment specified for <strong>the</strong> crime in questi<strong>on</strong>, however it shall not exceed twentyyears. In respect <str<strong>on</strong>g>of</str<strong>on</strong>g> cumulative sentences and waiver <str<strong>on</strong>g>of</str<strong>on</strong>g> right to trial, <strong>the</strong> terms <str<strong>on</strong>g>of</str<strong>on</strong>g> punishment specified in Subsecti<strong>on</strong>(2) <str<strong>on</strong>g>of</str<strong>on</strong>g> Secti<strong>on</strong> 85 and in Secti<strong>on</strong> 87/C shall apply, respectively.(2)(3) Any pers<strong>on</strong> committing a crime in affiliati<strong>on</strong> with organized crime shall be subject to expulsi<strong>on</strong> as a subsidiarypunishment.(4) Up<strong>on</strong> c<strong>on</strong>victi<strong>on</strong> for a crime committed in affiliati<strong>on</strong> with organized crime, <strong>the</strong> legal c<strong>on</strong>sequences prescribed inthis <str<strong>on</strong>g>Act</str<strong>on</strong>g> for crimes committed in criminal c<strong>on</strong>spiracy cannot be applied.(1) The entire durati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> preliminary detenti<strong>on</strong> shall be included in <strong>the</strong> final sentence, whe<strong>the</strong>r it is a term <str<strong>on</strong>g>of</str<strong>on</strong>g>impris<strong>on</strong>ment, community service, fine or fine as an ancillary punishment.(2) For <strong>the</strong> purposes <str<strong>on</strong>g>of</str<strong>on</strong>g> inclusi<strong>on</strong>, <strong>on</strong>e day <str<strong>on</strong>g>of</str<strong>on</strong>g> preliminary detenti<strong>on</strong> shall corresp<strong>on</strong>d to <strong>on</strong>e day <str<strong>on</strong>g>of</str<strong>on</strong>g> community serviceor to <strong>on</strong>e day’s worth <str<strong>on</strong>g>of</str<strong>on</strong>g> fine.(3) For <strong>the</strong> inclusi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> house arrest, <strong>on</strong>e day <str<strong>on</strong>g>of</str<strong>on</strong>g> community service or <strong>on</strong>e day’s worth <str<strong>on</strong>g>of</str<strong>on</strong>g> fine shall corresp<strong>on</strong>d to <strong>on</strong>eday, and <strong>on</strong>e day <str<strong>on</strong>g>of</str<strong>on</strong>g> impris<strong>on</strong>ment shall, depending <strong>on</strong> <strong>the</strong> degree <str<strong>on</strong>g>of</str<strong>on</strong>g> security <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> impris<strong>on</strong>ment, corresp<strong>on</strong>d to threeto five days <str<strong>on</strong>g>of</str<strong>on</strong>g> house arrest as c<strong>on</strong>sistent with court decisi<strong>on</strong>.(4) If any durati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> house arrest remains after <strong>the</strong> inclusi<strong>on</strong> under Subsecti<strong>on</strong> (3), it shall be counted as <strong>on</strong>e day <str<strong>on</strong>g>of</str<strong>on</strong>g>impris<strong>on</strong>ment.(5) Where <strong>the</strong> inclusi<strong>on</strong> c<strong>on</strong>cerns a fine, <strong>the</strong> amount-per-day ratio shall be calculated according to <strong>the</strong> formula set outin Subsecti<strong>on</strong> (2) <str<strong>on</strong>g>of</str<strong>on</strong>g> Secti<strong>on</strong> 65.
