(1) Any pers<strong>on</strong> who gains unauthorized entry to a computer system or network by compromising or defrauding <strong>the</strong>integrity <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> computer protecti<strong>on</strong> system or device, or overrides or infringes his user privileges, is guilty <str<strong>on</strong>g>of</str<strong>on</strong>g>misdemeanor punishable by impris<strong>on</strong>ment not to exceed <strong>on</strong>e year, work in community service or a fine.(2) Any pers<strong>on</strong> whowithout permissi<strong>on</strong> alters, damages or deletes data stored, processed or transmitted in a computer system ornetwork or denies access to <strong>the</strong> legitimate users,without permissi<strong>on</strong> adds, transmits, alters, damages, deletes any data, or uses any o<strong>the</strong>r means to disrupt use <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong>computer system or network is guilty <str<strong>on</strong>g>of</str<strong>on</strong>g> misdemeanor punishable by impris<strong>on</strong>ment not to exceed two years, work incommunity service or a fine.(3) Any pers<strong>on</strong> who, for financial gain or advantage,alters, damages or deletes data stored, processed or transmitted in a computer system or network or denies accessto <strong>the</strong> legitimate users,adds, transmits, alters, damages, deletes data or uses any o<strong>the</strong>r means to disrupt use <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> computer system ornetworkis guilty <str<strong>on</strong>g>of</str<strong>on</strong>g> fel<strong>on</strong>y punishable by impris<strong>on</strong>ment not to exceed three years.(4) The punishment for <strong>the</strong> criminal act defined in Subsecti<strong>on</strong> (3) shall beimpris<strong>on</strong>ment between <strong>on</strong>e to five years if it causes c<strong>on</strong>siderable damage,impris<strong>on</strong>ment between two to eight years if it causes substantial damage,impris<strong>on</strong>ment between five to ten years if it causes particularly substantial damage.(1) A pers<strong>on</strong> required to keep securities secrets who provides access to data declared securities secrets for thirdpers<strong>on</strong>s, commits a misdemeanor and shall be punishable with impris<strong>on</strong>ment <str<strong>on</strong>g>of</str<strong>on</strong>g> up to two years, labor in <strong>the</strong> publicinterest, or a fine.(2) The punishment for fel<strong>on</strong>y shall be three years impris<strong>on</strong>ment, if <strong>the</strong> crime was committedfor illegally gaining an advantage,by causing disadvantage to an investment service provider, stock exchange or clearing house, or to ano<strong>the</strong>r pers<strong>on</strong>.(3) No punishment shall apply <strong>on</strong> <strong>the</strong> grounds <str<strong>on</strong>g>of</str<strong>on</strong>g> revealing a securities secret against a pers<strong>on</strong>who c<strong>on</strong>veys informati<strong>on</strong> in fulfilling <strong>the</strong> duties prescribed in a separate act governing <strong>the</strong> publicati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> publicinformati<strong>on</strong> and informati<strong>on</strong> to be made available in <strong>the</strong> public interest, orwho c<strong>on</strong>veys informati<strong>on</strong> subject to <strong>the</strong> reporting obligati<strong>on</strong> prescribed in <strong>the</strong> <str<strong>on</strong>g>Act</str<strong>on</strong>g> <strong>on</strong> <strong>the</strong> Preventi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> M<strong>on</strong>eyLaundering or who initiates such acti<strong>on</strong>, even if <strong>the</strong> report he filed in good faith has proved to be unfounded.(1) Any pers<strong>on</strong> who, for <strong>the</strong> commissi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> criminal activities defined in Secti<strong>on</strong> 300/C,creates,obtains,distributes or trades, or o<strong>the</strong>rwise makes availablecomputer s<str<strong>on</strong>g>of</str<strong>on</strong>g>tware, passwords, entry codes, or o<strong>the</strong>r data with which to gain access to a computer system or network isguilty <str<strong>on</strong>g>of</str<strong>on</strong>g> misdemeanor punishable by impris<strong>on</strong>ment not to exceed two years, work in community service or a fine.(2) Any pers<strong>on</strong> who, for <strong>the</strong> commissi<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> criminal activities defined in Secti<strong>on</strong> 300/C, c<strong>on</strong>veys his ec<strong>on</strong>omic,technical and/or organizati<strong>on</strong>al expertise to ano<strong>the</strong>r pers<strong>on</strong> for <strong>the</strong> creati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> computer s<str<strong>on</strong>g>of</str<strong>on</strong>g>tware, passwords, entrycodes, or o<strong>the</strong>r data with which to gain access to a computer system or network shall be punished according toSubsecti<strong>on</strong> (1).
