(1) Any person who gains unauthorized entry to a computer system or network by compromising or defrauding theintegrity <strong>of</strong> the computer protection system or device, or overrides or infringes his user privileges, is guilty <strong>of</strong>misdemeanor punishable by imprisonment not to exceed one year, work in community service or a fine.(2) Any person whowithout permission alters, damages or deletes data stored, processed or transmitted in a computer system ornetwork or denies access to the legitimate users,without permission adds, transmits, alters, damages, deletes any data, or uses any other means to disrupt use <strong>of</strong> thecomputer system or network is guilty <strong>of</strong> misdemeanor punishable by imprisonment not to exceed two years, work incommunity service or a fine.(3) Any person who, for financial gain or advantage,alters, damages or deletes data stored, processed or transmitted in a computer system or network or denies accessto the legitimate users,adds, transmits, alters, damages, deletes data or uses any other means to disrupt use <strong>of</strong> the computer system ornetworkis guilty <strong>of</strong> felony punishable by imprisonment not to exceed three years.(4) The punishment for the criminal act defined in Subsection (3) shall beimprisonment between one to five years if it causes considerable damage,imprisonment between two to eight years if it causes substantial damage,imprisonment between five to ten years if it causes particularly substantial damage.(1) A person required to keep securities secrets who provides access to data declared securities secrets for thirdpersons, commits a misdemeanor and shall be punishable with imprisonment <strong>of</strong> up to two years, labor in the publicinterest, or a fine.(2) The punishment for felony shall be three years imprisonment, if the crime was committedfor illegally gaining an advantage,by causing disadvantage to an investment service provider, stock exchange or clearing house, or to another person.(3) No punishment shall apply on the grounds <strong>of</strong> revealing a securities secret against a personwho conveys information in fulfilling the duties prescribed in a separate act governing the publication <strong>of</strong> publicinformation and information to be made available in the public interest, orwho conveys information subject to the reporting obligation prescribed in the <strong>Act</strong> on the Prevention <strong>of</strong> MoneyLaundering or who initiates such action, even if the report he filed in good faith has proved to be unfounded.(1) Any person who, for the commission <strong>of</strong> the criminal activities defined in Section 300/C,creates,obtains,distributes or trades, or otherwise makes availablecomputer s<strong>of</strong>tware, passwords, entry codes, or other data with which to gain access to a computer system or network isguilty <strong>of</strong> misdemeanor punishable by imprisonment not to exceed two years, work in community service or a fine.(2) Any person who, for the commission <strong>of</strong> the criminal activities defined in Section 300/C, conveys his economic,technical and/or organizational expertise to another person for the creation <strong>of</strong> computer s<strong>of</strong>tware, passwords, entrycodes, or other data with which to gain access to a computer system or network shall be punished according toSubsection (1).
