It shouldbe noted that in some cases in which the authorization is obtained, theprosecutor may decide not to seek the immunity order from the courts.Therefore, the number of witnesses actually granted ill11lunity is probably lowerthan the data in the figure indicate. It should also be noted that data for1973 and 1974 include a total of II requests and 27 witnesses, and 7 requestsand II witnesses, respectively, falling under an older statute, l!:l U.S.C. 2514,which has since been repealed. "Criminal Division" refers specifically to theCriminal Division of the U.S. Deportment of Justice and includes the U.S.Attorneys.
