It shouldbe noted that in some cases in which the authorization is obtained, theprosecutor may decide not to seek the immunity order from the courts.Therefore, the number <strong>of</strong> witnesses actually granted ill11lunity is probably lowerthan the data in the figure indicate. It should also be noted that data for1973 and 1974 include a total <strong>of</strong> II requests and 27 witnesses, and 7 requestsand II witnesses, respectively, falling under an older statute, l!:l U.S.C. 2514,which has since been repealed. "<strong>Criminal</strong> Division" refers specifically to the<strong>Criminal</strong> Division <strong>of</strong> the U.S. Deportment <strong>of</strong> <strong>Justice</strong> and includes the U.S.Attorneys.
